<br />EXHIBIT B <br />CONDITIONS OF APPROVAL <br />CASE PUD-96-02 <br />STAPLES RANCH -- CALIFORNIA SOMERSET II <br />(February 12, 1997) <br /> <br />1. Development shall be substantially as shown on the development plans, Exhibit "A", <br />dated "Received February 3, 1997" on file with the Planning Department, except as <br />modified by the following conditions. Minor changes to the plans may be allowed <br />subject to the approval of the Planning Director iffound to be in substantial conformance <br />to the approved exhibits. <br /> <br />2. Approval of this PUD pre-zoning and development plan shall not take effect until the <br />recording of the annexation map and description by the Local Agency Formation <br />Commission (LAFCO). <br /> <br />3. This PUD development plan is subject to the policies and programs of the Stoneridge <br />Drive Specific Plan, as amended by Case SPA- 95-01, and is subject to all of the <br />Environmental Mitigations ofthe Stoneridge Drive Specific Plan (Exhibit C) unless <br />otherwise amended by subsequent mitigations listed in the Supplemental EIR prepared <br />for Case SPA-95-01 and as applied to this project. <br /> <br />4. All mitigation measures listed in Chapter 3, Section 3.2 of the Draft Supplemental EIR <br />and additional mitigations listed in the Final EIR prepared for SPA-95-01 (Exhibit C) and <br />as applied to this project are incorporated into these conditions by reference. <br /> <br />5. If archeological materials are uncovered during grading, trenching, or other on-site <br />excavation, all work on site shall be stopped and the City immediately notified. The <br />county coroner and the Native American Heritage Commission shall also be notified and <br />procedures followed as required in Appendix K of the California Environmental Quality <br />Act. A similar note shall appear on the improvement plans. <br /> <br />6. The developer acknowledges that the City of Pleasanton does not guarantee the <br />availability of sufficient sewer capacity to serve this development by the approval of this <br />case, and that the developer agrees and acknowledges that building permit approval may <br />be withheld if sewer capacity is found by the City not to be available. <br /> <br />Case PUD-96-02 <br /> <br />Conditions of Approval <br /> <br />Page B-1 <br />
