Some of these rates were effective before July 1, 2023, and those agencies may have had <br />another rate increase since then. <br />Collectively, these factors combine to demonstrate the critical need to begin to increase <br />rates, particularly for the water enterprise. The water rate increase is an initial step to <br />ensure the continued delivery of safe, reliable drinking water to the Pleasanton <br />community by immediately funding water system improvements, specifically including <br />the design of water line expansions on Stoneridge Drive, Bernal Avenue and Sunol <br />Boulevard, as well as a turnout replacement and booster station, all designed to allow <br />sufficient capacity of water to be delivered through the water distribution system. <br />Public Notice <br />Article XIII D, Section 3(a), added to the Constitution by Proposition 218, allows <br />agencies to adopt property-related fees, like water rates, if they issue a notice of public <br />hearing to all ratepayers no less than 45 days prior to the date of the public hearing and <br />hold a public hearing to adopt the proposed rates. <br />On July 18, 2023, the Council reviewed the proposed rates and authorized staff to mail <br />the Proposition 218 notice to the ratepayers regarding the proposed changes to the <br />water and sewer rates and set the public hearing date for consideration of this matter by <br />the City Council on September 19, 2023. The rate notice establishes the highest rate <br />that the City is permitted to adopt at this Public Hearing. The City may adopt rates lower <br />than the rates included in the Proposition 218 public hearing notice, but it may not adopt <br />Page 5 of 19
