<br />Resolution No. PC-97-04 <br />Page 2 <br /> <br />B. The proposed location of the conditional use and the conditions under <br />which it would be operated or maintained will not be detrimental to the public <br />health, safety, or welfare, or materially injurious to the properties or <br />improvements in the vicinity. <br /> <br />Given the professional nature of the proposed use, the proposed hours of <br />operation, the projected number of clients, and the size of the business, the <br />massage studio will not impact surrounding uses. The conditions of approval of <br />the use permit, including registration with the Police Department, will ensure that <br />the establishment remains within the standards of all applicable City codes. <br /> <br />C. The proposed conditional use will comply with each of the applicable <br />provisions of the zoning ordinance. <br /> <br />The site's C-C zoning conditionally permits the establishment of massage <br />facilities. The proposed use complies with all relevant sections of the zoning <br />ordinance. Granting a conditional use permit to operate a therapeutic massage <br />facility is consistent with the City's ability to regulate zoning as listed in <br />Municipal Code Section 18.124 "Conditional Uses." <br /> <br />D. The proposed location, development plan, and architectural treatment <br />comply with the standards contained in the Civic Overlay District. <br /> <br />The applicants would not be modifying the existing buildings, parking, <br />landscaping, drive aisles, or any other improvements in the Downtown Centre <br />complex. <br /> <br />E. The proposed use will be compatible with the Civic Center character of the <br />Civic Overlay District. <br /> <br />The Civic Center area can be characterized by its mix of commercial, office, and <br />residential uses. In addition to the City's Library and administrative offices, the <br />Civic Center area currently contains two residences, various retail stores, offices, <br />restaurants, and other service establishments. The proposed use would be <br />compatible with the uses in that it would provide an additional <br />professionally-staffed service establishment. <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); therefore, no environmental <br />document was prepared for this project. <br /> <br />WHEREAS, the Planning Commission determined that the proposed massage facility will be <br />situated to provide a safe and nuisance-free environment for patrons, users, and <br />adjacent property owners. <br />
