RESOLUTION NO. 23-1415 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, ACCEPTING AND APPROVING THE 2023 ANNUAL REPORT AND 2024 BUDGET OF THE DOWNTOWN PLEASANTON BUSINESS IMPROVEMENT DISTRICT ADVISORY BOARD AND DECLARING THE INTENTION TO LEVY AN ANNUAL ASSESSMENT FOR 2024 AND SETTING THE PUBLIC HEARING WHEREAS, the City of Pleasanton has heretofore established a Pleasanton Downtown Business Improvement District, the purposes and boundaries of which are set forth in Chapter 5.28, Pleasanton Municipal Code; and WHEREAS, the City of Pleasanton has heretofore appointed an Advisory Board for the Downtown Pleasanton Business Improvement District; and WHEREAS, said Advisory Board has prepared a 2023 annual report and a 2024 budget, attached as Exhibit A, which satisfies the statutory requirements of Streets and Highways Code §36533. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1. The report and budget of the Advisory Board are accepted and approved. SECTION 2. The City Council intends to levy and collect assessments within the District in 2024, for the proposed improvements and activities as provided in Chapter 5.28 of the Pleasanton Municipal Code. SECTION 3. The public hearing on the levy of the proposed assessment for 2024 is set for Tuesday, November 7, 2023, at 7:00 p.m., at which time written or oral protests to the assessment may be made. SECTION 4. As provided in §36534 of the Streets and Highways Code, the City Clerk shall notice of the public hearing by causing the resolution of intention to be published once in a newspaper of general circulation in the city not less than seven days before the public hearing.
