unpaid, shall run concurrently with Family Medical Leave, California Family Rights Leave and <br /> Pregnancy Disability Leave in accordance with City Policy. <br /> With a recommendation by the Chief of Police and approval by the Director of Human <br /> Resources and Labor Relations, the City Manager may extend the leave for up to an additional <br /> thirty (30) days. In unusual circumstances involving catastrophic illness, the City Manager <br /> may, upon the recommendation of the Chief of Police and Director of Human Resources and <br /> Labor Relations,extend a leave of absence without pay up to but not exceeding one year from <br /> the date of disability. <br /> The term medical disability includes all temporary medical disabilities including pregnancy, <br /> childbirth and associated medical conditions. <br /> Such request for medical leave will be considered only upon provision of a physician's <br /> statement in the same format utilized for Family Medical Leave (FMLA). <br /> During extended medical leave, an employee shall not accrue vacation or sick leave benefits or <br /> be eligible for holidays, nor shall such time be considered as service time. <br /> Any employee returning from extended medical leave shall be required to provide a physician's <br /> release to return to duty. <br /> 13.3 Jury Leave <br /> Every employee of the City who is called or required to serve as a juror shall be entitled to <br /> leave from his/her duties with the City during the period of such service or while necessarily <br /> being present in court as a result of such call. The employee shall be paid the difference <br /> between his/her full salary and any payment received by him/her, except travel pay, for such <br /> duty. <br /> 13.4 Leaves Resulting from Subpoena <br /> Leave of absence with pay shall be granted to a person while going to and from court and <br /> answering a subpoena as a witness. The employee shall be paid the difference between his/her <br /> full salary and any payment received by him/her, except travel pay, for such duty. Employees <br /> shall notify the Division Commander or his/her designee, of such a subpoena as soon as <br /> feasible. <br /> 13.5 Militar-N Leave <br /> Military leave shall be granted in accordance with the provisions of State or Federal law. <br /> 13.6 Return from Leave <br /> Upon the expiration of a regularly approved leave, the employee shall be reinstated in the <br /> position held at the time the leave was granted. In the event the approved leave exceeds ninety <br /> (90) calendar days for medical leaves or thirty (30) calendar days for all other leaves, the <br /> employee may not be guaranteed his/her specific assignment or work schedule. Failure on the <br /> part of an employee on leave to report promptly at its expiration shall be cause for discipline up <br /> to and including dismissal. <br /> 15 <br />
