<br /> <br /> RESOLUTION NO. PC-2023-10 <br /> <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON APPROVING THE APPLICATION FOR A CONDITIONAL USE <br />PERMIT TO OPERATE RESURRECTION GREEK ORTHODOX CHURCH ON AN <br />APPROXIMATELY 4.3-ACRE SITE LOCATED AT 11300 DUBLIN CANYON ROAD, <br />AS FILED UNDER CASE NO. P23-0338 <br /> <br />WHEREAS, on July 14, 2021, the Planning Commission held a duly-noticed <br />public hearing and unanimously approved Conditional Use Permit (CUP Case No. <br />P20-0994) from Guy Houston, on behalf of Resurrection Greek Orthodox Church who <br />applied for a Conditional Use Permit to construct and operate an approximately 9,792- <br />square-foot church and approximately 24,971-square-foot multi-purpose building with <br />gymnasium on an approximately 4.3-acre site (“Project”) located at 11300 Dublin <br />Canyon Road (“Property”); and <br /> <br />WHEREAS, Conditions of Approval No. 2 stated the CUP approval will lapse and <br />shall become void one year following the date on which the CUP became effective, <br />unless prior to the expiration of one year a building permit is issued and construction is <br />commenced and diligently pursued toward completion on the site which was the subject <br />of the CUP application; or a certificate of occupancy is issued for the structure which <br />was the subject of the CUP application; or the site is occupied if no building permit or <br />certificate of occupancy is required; or the applicant or his/her successor has filed a <br />request for extension with the Zoning Administrator pursuant to the provisions of the <br />Pleasanton Municipal Code; and <br /> <br />WHEREAS, On July 29, 2022, P20-0994 approval expired when no building <br />permit was filed or a request for an extension was made; and <br /> <br />WHEREAS, On April 12, 2023, Anna Win, on behalf of resurrection Greek <br />Orthodox Church (“Applicant”) requested the prior CUP approval be reinstated as no <br />changes to the Project are proposed; and <br /> <br />WHEREAS, the Property is Zoned PUD-RDR/A-OS (Planned Unit Development <br />– Rural Density Residential/Agriculture and Open Space) District; and <br /> <br />WHEREAS, The proposed project is consistent with the development density, <br />land uses, development standards and other key parameters established by the <br />Pleasanton Municipal Code, PUD Development Plan, and General Plan, which were <br />reviewed pursuant to CEQA in a previously certified and/or adopted environmental <br />document including the Environmental Impact Report (EIR) prepared for the Pleasanton <br />2005-2025 General Plan, certified in July 2009 which was adopted and certified by the <br />City Council in 2009 under City Council Resolution No. 09-312. In order to provide <br />additional project-level analysis, the applicant provided an additional Arborist <br />Report/Tree, Biological Resources Analysis, Geotechnical Investigation, Noise <br />Assessment Study, and Health Risk Assessment Memorandum. The assessments <br />identified measures sufficient to reduce project impacts to a less-than-significant level, <br />and these measures are incorporated as conditions of approval.
