IN THE CITY COUNCIL OF THE <br />CITY OF PLEASANTON <br />STATE OF CALIFORNIA <br /> <br />ORDINANCE NO. 355 <br /> <br />AMENDING ORDINANCE NO. 245 (BUSINESS LICENSES) <br />AS AMENDED, PROVIDING FOR PROCEDURE FOR TYPE D <br />BUSINESS LICENSES PERMITS, AND REPEALING SECTIONS <br />16.01 through 16.06 THEREOF <br /> <br />The City Council does hereby ordains as follows: <br /> <br /> SECTION 1. Sections 16.01 through 16.06 of Ordinance <br />No. 245, (Business License Tax) as amended, is hereby amended in <br />the following manner: <br /> <br /> § 16.01 Every person carrying on any of the fol- <br />lowing enumerated businesses shall be subject to special permits <br />from the City Administrator to be first had and obtained before <br />carrying on said business. <br /> <br /> § 16.02 A written application must be filed for <br />such permits on forms provided by the License Collector within <br />seven (7) days of commencing business or the date of any special <br />event proposed. The license collector may in bis discretion <br />waive the timely filing of an application for a charitable event <br />of an organization which is exempt under section 18 of this <br />ordinance. <br /> <br /> § 16.03 A filing fee of $5.00 shall accompany all <br />applications for special permits. The Collector shall not con- <br />sider any such applications until the license fees have first <br />been deposited with him and the filing fee paid. <br /> <br /> § 16.04 Upon granting of the special permit by the <br />City, the licensee shall forthwith comply with all the conditions <br />and provisions under which such special permits were granted; <br />whereupon the Collector shall then be authorized to issue the <br />propers: license, using the license fee deposited. <br /> <br /> § 16.05 Upon failure of the applicant to comply <br />with all provisions of such special permits within thirty (30) <br />days, or within twenty-four (24) hours prior to the special <br />event for which the permit is issued, the license fee shall be <br />forfeited to the City, and any license issued shall be revoked. <br /> <br /> § 16.06 In the event the application for the special <br />permit is denied, the license fee deposited, but not the filing <br />fee, shall be returned to the applicant on proper demand to the <br />Collector. <br /> <br /> SECTION 2. The City Clerk shall certify to the adoption <br />of this Ordinance and cause it to be published once in "THE TIMES'~ <br />a newspaper of general circulation published with the City. <br /> <br /> ~ECTION 3. This Ordinance provides for a tax levy for <br />the usual current expenses of the City, and shall take effect <br />ir~ediately pursuant to Section 1 of Article 4 of the Constitution <br />of the State of California, and Section 36037 of the Government <br />Code. <br /> <br />- 1- <br /> <br /> <br />
