EXHIBIT A RESOLUTION NO. PC-2023-14 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RECOMMENDING THE CITY COUNCIL APPROVE AN APPLICATION FOR A PLANNED UNIT DEVELOPMENT (PUD) DEVELOPMENT PLAN TO ESTABLISH DEVELOPMENT STANDARDS FOR 2207 MARTIN AVENUE, AS FILED UNDER CASE NO. PUD-148 WHEREAS, on March 17, 2023, Meenu Gochhwal and Ashish Choudhary ("Applicant") applied for PUD development plan approval under case No. PUD-148 to establish development standards for 2207 Martin Ave ("Property"); and WHEREAS, the Property is designated Low Density Residential in the General Plan; and WHEREAS, the zoning for the Property is PUD-LDR (Planned Unit Development — Low Density Residential) District; and WHEREAS, environmental review for the project was undertaken with the Initial Study/Negative Declaration adopted by the City Council for RZ-97-2 in conformance with the standards of the California Environmental Quality Act (CEQA). There are not substantial changes to the project or the circumstances under which the project is being undertaken that involve new significant environmental effects or that substantially increase the severity of previously identified effects. Furthermore, there is no new information of substantial importance which was unknown at the time the Initial Study/Negative Declaration was adopted by the City Council regarding the project or its effects, mitigation measures, or alternatives. Any previously identified effects or impacts are mitigated to a level of insignificance, with the mitigation measures incorporated into the project's design or imposed on the project pursuant to the conditions of approval. Therefore, no new environmental document accompanied the project; and WHEREAS, on August 23, 2023, the Planning Commission held a duly-noticed public hearing and considered relevant exhibits, recommendations of the City staff concerning this application, and received testimony from the applicant and interested parties. NOW, THEREFORE BE IT RESOLVED by the Planning Commission of the City of Pleasanton, based on the entire record of proceedings, including the oral and written staff reports and all public comment and testimony: Section 1: Findings for PUD Development Plan Approval With respect to the approval of the PUD development plan, the Planning Commission makes the following findings and determinations with respect to each of the considerations for approval of a PUD Development Plan as required by Section 18.68.110 of the Pleasanton Municipal Code (PMC): 1. Whether the proposed development plan is in the best interest of the public health, safety, and general welfare.
