In addition, The <br /> California Department of Housing and Community Development (HCD) received <br /> technical modifications, authorized by Resolution No. 23-1406, on August 24, 2023. <br /> These technical modifications were made available to the public for seven days before <br /> HCD's review and the City confirmed the modifications are consistent with the direction <br /> and authority granted by Resolution No. 23-1406. Pursuant to Government Code <br /> section 65585, subdivision (h), HCD is reporting the results of its review. Our review <br /> was facilitated by conversations on July 12, 2023 and August 16. 2023 with the City's <br /> housing element update team. In addition, HCD considered comments from <br /> Farella Braun-Martel, Housing Action Coalition, California Housing Defense Fund, and <br /> Kevin Burke pursuant to Government Code section 65585, subdivision (c). <br /> HCD is pleased to find the adopted housing element in substantial compliance with <br /> State Housing Element Law (Gov. Code, § 65580 et seq) as of August 25, 2023. The <br /> adopted element addresses the statutory requirements described in HCD's <br /> April 10, 2023 review. <br /> Additionally, the City must continue timely and effective implementation of all programs <br /> including but not limited to the following: <br /> • Program 1.3 (BART-TOD Zoning Standards) <br /> • Program 1.5 (Assist Affordable Housing Projects) <br /> • Program 1.7 (Large Sites) <br /> • Program 1.8 (Accessory Dwelling Units) <br /> • Program 1.9 (Accessory Dwelling Units — Incentives) <br /> • Program 1.10 (Annexation) <br /> • Program 2.1 (Inclusionary Zoning) <br />
