In addition, The California Department of Housing and Community Development (HCD) received technical modifications, authorized by Resolution No. 23-1406, on August 24, 2023. These technical modifications were made available to the public for seven days before HCD's review and the City confirmed the modifications are consistent with the direction and authority granted by Resolution No. 23-1406. Pursuant to Government Code section 65585, subdivision (h), HCD is reporting the results of its review. Our review was facilitated by conversations on July 12, 2023 and August 16. 2023 with the City's housing element update team. In addition, HCD considered comments from Farella Braun-Martel, Housing Action Coalition, California Housing Defense Fund, and Kevin Burke pursuant to Government Code section 65585, subdivision (c). HCD is pleased to find the adopted housing element in substantial compliance with State Housing Element Law (Gov. Code, § 65580 et seq) as of August 25, 2023. The adopted element addresses the statutory requirements described in HCD's April 10, 2023 review. Additionally, the City must continue timely and effective implementation of all programs including but not limited to the following: • Program 1.3 (BART-TOD Zoning Standards) • Program 1.5 (Assist Affordable Housing Projects) • Program 1.7 (Large Sites) • Program 1.8 (Accessory Dwelling Units) • Program 1.9 (Accessory Dwelling Units — Incentives) • Program 1.10 (Annexation) • Program 2.1 (Inclusionary Zoning)
