24. Only modular newspaper dispensers accommodating more than one newspaper shall be allowed outside of buildings within the development. The design of these dispensers shall be approved by the Planning Director. Dispensers within the public right-of-way shall require an encroachment permit by the Engineering Department. Landscaping and Irrigation gystem Design and Operation: 25. All street trees facing Bernal Avenue and Utah Street shall be a minimum 24-inch box-size species. This change shall be shown on the building permit plan set for review and approval by the Planning Director before issuance of a building permit. 26. All groundcover species in the perimeter landscape areas along the west, south, and east sides of the project site shall be chosen to function as vegetative filters. This change shall be shown on the building permit plan set for review and approval by the Planning Director and the City's Landscape Architect before issuance of a building permit. 27. The project developer shall enter into an agreement with the City, approved by the City Attorney, which guarantees that all landscaping and open space areas included in this project will be maintained at all times in a manner consistent with the approved landscape plan for this development. Said agreement shall run with the land for the duration of the existence of the structures located on the subject property. 28. A final landscape plan and irrigation plan shall be submitted to and approved by Planning Director as part of the building permit plan set prior to issuance of an on-site permit. Said landscape plan shall be consistent with the approved landscape plan plus any conditions of approval, and shall be detailed in terms of species, location, size, quantities, and spacing. 29. All trees used in landscaping be a minimum of 15-gallons in size and all shrubs a minimum of five-gallons, unless otherwise shown on the approved landscape plan or conditioned by this approval. 30. Six-inch vertical concrete curbs shall be installed between all paved and landscaped areas unless otherwise shown on the development plan and/or required by a condition of approval. 31. The project developer shall provide root control barriers and four-inch diameter perforated pipes for parking lot trees, street trees, and trees in planting areas less than 10 feet in width, as determined necessary by the Planning Director at the time of review of the final landscape plans. 32. Prior to occupancy, the landscape architect shall certify in writing to the Planning Director that the landscaping has been installed in accordance with the approved landscape and irrigation plans with respect to size, number, and species of plants and overall design concept. 5
