CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, ALAMEDA <br /> <br /> RESOLUTION NO. 04-081 <br /> <br /> RESOLUTION APPROVING THE APPLICATION OF <br />FAIRLAND INVESTMENT, INC. FOR DESIGN REVIEW AND A <br />CONDITIONAL USE PERMIT, AS FILED UNDER CASE PDR-289/PCUP-86 <br /> <br />WHEREAS, <br /> <br />Faifland Investment, Inc. has applied for design review approval and a <br />conditional use permit for a self-service gasoline station on an <br />approximately 1.25-acre site located at 3121 Bernal Avenue and 3581 Utah <br />Street consisting of eight fuel pump dispensers, a drive-through carwash, <br />and a 3,600-square-foot convenience market; and <br /> <br />WHEREAS, zoning for the property is PUD-C (Planned Unit Development - <br /> Commercial) Dislxict; and <br /> <br />WHEREAS, <br /> <br />a duly noticed public hearing was held before the City Council on <br />October 19, 2004, at which time all pertinent testimony and documents <br />were received; and <br /> <br />WHEREAS the City Council determined that the proposed project, as conditioned, is <br /> appropriate for the site. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1. <br /> <br />Approves Case PDR-289/PCUP-86, the application of Fairland Investment, <br />Inc. for design review approval and a conditional use permit for a <br />self-service gasoline station on an approximately 1.25-acre site located at <br />3121 Bemal Avenue and 3581 Utah Street consisting of eight fuel pump <br />dispensers, a drive-through carwash, and a 3,600-square-foot convenience <br />market, subject to the conditions of approval shown on Exhibit B for design <br />review and Exhibit C for the conditional use permit, which exhibits are <br />attached hereto and incorporated herein by this reference. <br /> <br /> <br />
