Resolution No. PC-2023-09 <br />Page 2 of 3 <br /> <br /> <br /> <br />WHEREAS, on November 14, 2022, the City received a letter from HCD providing its <br />findings regarding the draft Housing Element; and <br /> <br />WHEREAS, on January 4, 2023, the City published a revised draft Housing Element <br />responding to HCD’s findings and requested public comment on the draft; and <br /> <br />WHEREAS, on January 26, 2023, in accordance with the requirements of the California <br />Environmental Quality Act, the City Council certified a Program Environmental Impact Report <br />(Program EIR) for the 6th Cycle Housing Element Update <br /> <br />WHEREAS, on January 26, 2023, the City Council adopted the 2023-2031 6th Cycle <br />Housing Element; and <br /> <br />WHEREAS, on February 14, 2023, the City submitted the adopted Housing Element to <br />HCD for review and certification; and <br /> <br />WHEREAS, on April 10, 2023, HCD provided a comment letter to the City; and <br /> <br />WHEREAS, on May 10, 2023 the Planning Commission conducted a duly and properly <br />noticed public hearing, reviewed the City’s response to HCD’s comments, and reviewed the <br />proposed modifications to the adopted Land Use Element and Housing Element; and <br />determined the Housing Element to be consistent with State law and the General Plan of the <br />City; and <br /> <br />WHEREAS, the modifications to the Housing Element remain consistent with the scope <br />of the project analyzed in the previously certified Program EIR Housing Element <br /> <br />NOW, THEREFORE BE IT RESOLVED by the Planning Commission of the City of Pleasanton, <br />based on the entire record of proceedings, including the oral and written staff reports and all <br />public comment and testimony: <br /> <br />Section 1: Finds that the foregoing recitals are true and correct and are incorporated by <br />reference into this action. <br /> <br />Section 2: The Planning Commission finds that the Housing Element, as revised complies <br />with Housing Element Law, as provided in Government Code Sections 65580 et <br />seq and contains all provisions required by State Housing Element Law, and as <br />previously enumerated in Attachment 1B to Resolution 2023-02. <br /> <br />Section 3: Recommends that the City Council find that based on substantial evidence in the <br />record including that non-vacant higher density RHNA sites are primarily <br />underutilized as surface parking and/or surface parking with commercial buildings <br />where the existing uses are of marginal economic viability, the structures are at or <br />near the end of their useful life, and the City has received affirmative interest in <br />developing housing, the existing uses on the no n-vacant sites identified in the site <br />inventory to accommodate the RHNA are likely to be discontinued during the <br />DocuSign Envelope ID: 41DE696A-8D83-4D96-A56C-914D79B32B67
