RESOLUTION NO. 23-1398 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> EXPRESSING SUPPORT FOR OUR NEIGHBORHOOD VOICES INITIATIVE DRAFT <br /> WHICH PROVIDES THAT LOCAL LAND USE AND ZONING LAWS OVERRIDE <br /> CONFLICTING STATE LAWS <br /> WHEREAS, the City of Pleasanton believes that local jurisdictions should determine for <br /> themselves the land use and zoning policies and practices that best suit each city and its residents <br /> instead of imposed mandates that do not take into account the needs and differences of <br /> jurisdictions throughout the State of California; and <br /> WHEREAS, the initiative draft provides that local land use and zoning laws override <br /> conflicting state laws would be a State Constitutional Amendment that would provide that city and <br /> county land use and zoning laws (including local housing laws) would override all conflicting state <br /> laws, except in certain circumstances related to three areas of statewide concern. And it would <br /> prevent the state legislature and local legislative bodies from passing laws invalidating voter- <br /> approved local land use or zoning initiatives and would prohibit the state from changing, granting, <br /> or denying funds to local governments based on their implementation of the measure; and <br /> WHEREAS, the City Council of the City of Pleasanton feels strongly that local control of <br /> land use and zoning matters is important to the community and that the voters should decide. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. The Our Neighborhood Voices initiative draft that provides that local land <br /> use and zoning laws override conflicting state laws should go on the ballot for the voters of <br /> California to decide. <br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on June 6, 2023. <br /> I, Jocelyn Kwong, City Clerk of the City of Pleasanton, California, certify that the foregoing <br /> resolution was adopted by the City Council at a regular meeting held on June 6, 2023, by the <br /> following vote: <br /> Ayes: Councilmembers Arkin, Nibert, Testa <br /> Noes: Councilmember Balch, Mayor Brown <br /> Absent: None <br /> Abstain: None <br /> Jdce�yn K on ity Clerk <br /> APP OV S TO FORM: <br /> Daniel G.
