The Fire Chief,and/or designee,has the discretion to administratively reassign personnel for up to four <br /> (4)months per assignment to meet Department needs. This shall not apply to probationary employees <br /> or assignments not resulting in the displacement of another employee. Transfer for purposes of <br /> punishment shall be done in accordance with Section 19- Discipline. <br /> A "Mutual" is an agreement between two individuals of the same rank to trade Station and/or shift <br /> assignments for a specific period of time. Mutuals are not permanent. Mutuals can be between <br /> individuals on the same shift or on different shifts. The individuals involved may set the time frame <br /> of the"Mutual",however,no mutual shall exceed twelve(12)months from the initial date. At the end <br /> of the twelve months both individuals will return to their original assignments. Both individuals must <br /> physically be able to meet their assigned Station requirements, i.e., if one of the individuals is unable <br /> to return to work within the first one-year period due to any reason, the "Mutual" is considered null <br /> and void. Individuals must be qualified for the position of the person with whom they are requesting <br /> the "Mutual". <br /> Personnel may submit a request for a mutual, in writing,to the Fire Chief, and/or designee. Requests <br /> will be evaluated and approved on a case-by-case basis, based on department need. <br /> Section 7. Holiday Pay <br /> 7.1 Holiday In Lieu <br /> Battalion Chiefs assigned to a 56-hour work schedule are eligible to receive holiday-in lieu pay at the <br /> rate of 7.5%of the base salary. Holiday-in-lieu pay shall be paid on a biweekly basis.Battalion Chiefs <br /> shall receive holiday in lieu pay without regard for when holidays occur or whether such employees <br /> actually work on recognized holidays. Holiday in lieu pay will be reported as special compensation <br /> within the meaning of Section 20636 of the California Government Code and Section-571(a)(5)of the <br /> CalPERS regulations and/or as defined pensionable compensation pursuant to the California <br /> Government Code and the Ca1PERS regulations as amended. <br /> 7.2 Observed Holidays <br /> The following holidays are observed for the Battalion Chief s unit. Battalion Chiefs who work a 40 <br /> hour per week schedule are permitted to be off work on observed holidays without the loss of pay and <br /> do not qualify for the holiday in lieu pay provided per Section 9.1 of this MOU. <br /> 1.
