Section 4. The City Council finds that based on substantial evidence in the record including <br /> that non-vacant higher density RHNA sites are primarily underutilized as surface <br /> parking and/or surface parking with commercial buildings where the existing uses <br /> are of marginal economic viability, the structures are at or near the end of their <br /> useful life, and the City has received affirmative interest in developing housing, <br /> the existing uses on the non-vacant sites identified in the site inventory to <br /> accommodate the RHNA are likely to be discontinued during the planning period <br /> and therefore do not constitute an impediment to planned residential development <br /> on the sites during the planning period. as described more particularly in Exhibit C <br /> to this resolution, incorporated herein by this reference and further enumerated in <br /> Exhibit A3 of City Council Resolution No. 23-1358. <br /> Section 5. The City Council finds that the Housing Element incorporates the City's goals, <br /> quantifiable objectives, and policies to affirmatively further fair housing and the <br /> maintenance, preservation, improvement, and development of housing per <br /> Government Code §65583(b). <br /> Section 6. The City Council adopts the General Plan amendments to the Land Use Element <br /> (Exhibit A) and Housing Element (Exhibit B) that have been modified in response <br /> to the findings of HCD as being in substantial compliance with the requirements <br /> of State Housing Element Law, as previously enumerated in Exhibit A2 to City <br /> Council Resolution No. 23-1358. <br /> Section 7. The Director of Community Development or designee is hereby directed to file all <br /> necessary material with HCD for HCD to find that the Housing Element is in <br /> conformance with State Housing Element Law and is further directed <br /> and authorized to make all typographical and non-substantive changes to the <br /> Land Use Element and Housing Element to make them internally consistent or to <br /> address any non-substantive changes or amendments requested by HCD to <br /> achieve HCD certification of the Housing Element. <br /> Section 8. The Director of Community Development or designee is hereby directed to <br /> distribute copies of the Housing Element in the manner provided in Government <br /> Code §§65357 and 65589.7. <br /> Section 9. This resolution shall take effect immediately upon its passage and adoption. <br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at a <br /> regular meeting held on June 6, 2023. <br /> I.
