specially benefitted by construction proposed in a plan of control approved by the legislative body and (2) the assessments were previously approved by all property owners at the time the assessment was created. Since these criteria have been satisfied, the GHAD assessments can be increased by an amount not exceeding the ENR index without being subject to a Proposition 218 vote of current property owners. Staff did not schedule an informational meeting this year as there were no public inquiries in the past year. Staff recommends the GHAD Board schedule the public hearing for June 20, 2023, at 6:55 p.m. to receive comments on the proposed assessments. Additionally, public notices will be sent to all property owners within each GHAD notifying them that this agenda report is available on the City's website (in addition to the normal postcard noticing information). Any questions from owners will be presented to the GHAD Board of Directors, along with staff responses, on or before the June 20, 2023, agenda report. Contract Amendment with GHAD Consultant Despite performing maintenance within each GHAD prior to the arrival of winter storms, the Laurel Creek GHAD experienced a minor landslide that damaged an access road extending west of Crosby Drive to Dublin Canyon Road. The damage must be assessed by the City's consulting geotechnical engineer, ENGEO, Inc., in order to develop a repair scheme. The repair can then be implemented in fall 2023 together with other routine GHAD maintenance. The ENGEO Inc., cost proposal exceeds the amount available from the original contract plus contingency. The original contract presented to the City Council on December 15, 2020, limited total expenditures during the four-and-one-half-year term to $116,907. Of this amount, $112,909 has been encumbered, leaving $3,998 available. ENGEO's proposal for the damage assessment and repair scheme is $22,500. As such, the City must authorize a contract amendment in the amount of $18,502 for the work within the Laurel Creek GHAD to proceed. This will bring ENGEO's current contract amount to $135,409 for all CHAD-associated consulting work. This will reduce the total current fund reserve from $1 ,022,692 to $1 ,004,190.
