enumerated in Exhibit A3 of City Council Resolution No. 23-1358 and following additional facts <br /> and evidence: <br /> 411 and 5th Cycles Sites: Evidence to develop non-vacant Sites previously designated in the 4th <br /> or 5th Housing Element Cycles, is as follows, in addition to facts enumerated in Exhibit A3 of <br /> City Council Resolution No. 23-1358 and the facts stated in Housing Element Appendix B: <br /> For the BART Site (APN 941-2771-15 and 941-2778-2), evidence through Program 1.3 to re- <br /> zone the site at the minimum density required by AB 2923 and to proactively engage with <br /> BART to facilitate planning and redevelopment of the site. Communication with BART staff <br /> during the housing element update to affirm BART's interest in pursuing housing development, <br /> discuss and reconcile potentially conflicting provisions of BART's work plan with its more <br /> recently adopted Transit Oriented Development (TOD) policy, and communication received <br /> from BART specifying the site as a mid-term, rather than long-term site, meaning planning to <br /> be undertaken starting in 2025, and not precluding development in the 8-year planning period. <br /> Further evidence in the City's adoption of Objective Design Standards by City Council <br /> Resolution No. 23-1360 in January 2023 for the site, consistent with AB 2923, and in <br /> recognition of the constraint posed by the desire to retain sufficient commuter parking, <br /> conservatively assuming only half the available acreage at the BART site would be <br /> redeveloped with housing, and commitment by the City in Program 1.3 to seek funding sources <br /> for replacement parking. <br /> Sites Proposed for Re-Zoning Suitable for Lower-Income Housing: Evidence of suitable sites <br /> to accommodate lower-income housing, is as follows, in addition to facts enumerated in Exhibit <br /> A3 of City Council Resolution No. 23-1358 and the facts stated in Housing Element Appendix <br /> B: <br /> • Area 5: Laborers Council. Evidence through communications with representatives of the <br /> property owner, voicing affirmative interest in redeveloping housing on the site within <br /> the next eight years that maximizes the potential unit count. <br /> 3 <br />
