Locations project. The removal of the unspent and rescinded funding of $190,000 in CIP <br /> 22570 has been incorporated into the Proposed FY 2023/24-FY 2024/25 Capital <br /> Budget. <br /> BACKGROUND <br /> The Transportation Development Act is a State law that provides funding through state <br /> sales tax for projects that comply with regional transportation plans. Article 3 of the TDA <br /> provides funding for bicycle and pedestrian related projects. The Metropolitan <br /> Transportation Commission oversees the allocation of these funds, based on <br /> population, within the nine county MTC region. MTC makes annual distributions of TDA <br /> Article 3 funds to eligible claimants after review of applications submitted. <br /> Eligible project types for these funds include the construction and/or engineering of a <br /> capital project that would construct or maintain a bikeway; bicycle safety education <br /> programs; development of bicycle or pedestrian facilities; restriping of bike lanes and <br /> other pedestrian and bicycle related construction projects. <br /> DISCUSSION <br /> The City previously requested $190,000 in TDA Article 3 funding for the 1-580 <br /> Pedestrian and Bicycle Overcrossing Improvement project (CIP No. 22570). MTC's <br /> funding allocation has a three-year expenditure timeline. Due to the pandemic, the 1-580 <br /> Pedestrian and Bicycle Overcrossing Improvement Project did not meet the expenditure <br /> deadline — these funds were not able to be utilized by this project. <br /> The City does not lose this money; MTC requires unexpended allocations be rescinded <br /> and reallocated. Staff recommends this rescinded allocation be reallocated to the <br /> Bicycle and Pedestrian Improvements at Various Locations project. Placing the TDA <br /> funding in this project allows flexibility in use of the money but does not preclude future <br /> use on the 1-580 Overcrossing Project when the project is approved by Caltrans and <br /> ready for construction. <br /> Per TDA Article 3 guidelines, staff is required to present the TDA Article 3 fund request <br /> to the City's Bicycle, Pedestrian, and Trails Committee (BPTC). The BPTC reviewed the <br /> application at its March 27, 2023. The projects discussed for possible funding include <br /> Valley Avenue Stop Controlled Pedestrian Improvements, Stoneridge Drive Protected <br /> Bicycle Lanes (Rheem Drive to Guzman Parkway), and 1-580 overcrossing <br /> improvements. There is a possibility to use this funding for a new project or another <br /> project like West Las Positas Multimodal Improvement Project, which fall within the <br /> annual bicycle and pedestrian improvements category; it is standard practice for <br /> projects to be reviewed by the BPTC prior to using TDA Article 3 funding. At the March <br /> 2023 meeting the BPTC recommended City Council approve the application for <br /> $493,513 in TDA Article 3 funds to be allocated to the Annual Bicycle and Pedestrian <br /> Improvements at Various Locations project. <br /> Staff recommends the City Council adopt the attached resolution authorizing an <br /> application for TDA Article 3 funds and remove the previous allocation of$190,000 in <br /> Page 2 of 3 <br />
