Resolution No. 04-66 <br />Page Five <br /> properties, to reduce the bulk of the structure, and to provide <br /> adequate separation of structures for privacy. The existing two-story <br /> accessory building is located in the rear yard, approximately ten feet <br /> behind the rear wall of the neighbor's house at 4420 First Street. In <br /> addition, the existing accessory building is approximately 25 feet <br /> from the adjoining property to the south. Thus, given the distance <br /> between the subject accessory building and the houses on the <br /> adjoining properties, the existing two-story accessory building <br /> would not adversely impact the light, air, open space, and views <br /> between properties. Therefore, granting of this variance would not <br /> be detrimental to the public health, safety, or general welfare or <br /> materially injurious to properties in the area, and this finding for the <br /> sloping plane variance can be made. <br /> <br />Building Height Variance. The architecture of the existing structure <br />complements the design of the existing house when viewed from <br />First Street and would be in keeping with the character of the <br />Downtown area. Due to the location of the existing detached <br />two-story building and that of the existing houses on the adjoining <br />properties to the north and to the east, the existing structure would <br />not be overbearing to the adjacent properties nor adversely impact <br />the light, air, open space, and views between properties. Therefore, <br />the granting of this variance would not be detrimental to the public <br />health, safety, or general welfare or materially injurious to properties <br />in the area, and this finding for the building height variance can be <br />made. <br /> <br />Section 2. <br /> <br />Approves the application of Jean Luc and Maureen Chatelain for variances <br />from the Municipal Code and for administrative design review approval to <br />legalize an existing two-story accessory structure located at 4432 First <br />Street with a second unit on the second floor (1) to allow the building to be <br />located approximately two feet, six inches from the side (northerly) <br />property line and approximately one foot, nine inches from the rear <br />(easterly) property line where a minimum five-foot side yard setback and a <br />minimum ten-foot rear yard setback, respectively, are required for a <br />detached second unit; (2) to allow the building to be approximately 25 feet <br />in height where a maximum building height of 15 feet is allowed for a <br />detached accessory structure; and (3) to allow the northern sloping plane to <br />be approximately three feet from the side (northerly) property line where a <br />minimum of ten feet is required, subject to the conditions shown on <br />"Exhibit B," attached hereto and made a part of this case by reference. <br /> <br /> <br />
