Ordinance No. 2245 <br /> Page 12 of 34 <br /> Surveys will include all line-of-sight trees within approximately 500 feet (for <br /> raptors) and all vegetation (including bare ground) within approximately 250 feet <br /> for all other species. <br /> • Based on the results of the surveys, avoidance procedures will be adopted, if <br /> necessary, on a case-by-case basis. These may include construction buffer <br /> areas (up to several hundred feet in the case of raptors) or seasonal avoidance <br /> • Bird nests initiated during construction are presumed to be unaffected, and no <br /> buffer would be necessary except to avoid direct destruction of a nest or mortality <br /> of nestlings. <br /> • If pre-construction surveys indicate that nests are inactive or potential habitat is <br /> unoccupied during the construction period, no further mitigation is required. Trees <br /> and shrubs that have been determined to be unoccupied by nesting or other <br /> special-status birds may be pruned or removed. <br /> MM 4.D-3. In the event that paleontological resources are encountered during the <br /> course of development, all construction activity must temporarily cease in the affected <br /> area(s) until the uncovered fossils are properly assessed by a qualified Paleontologist <br /> and subsequent recommendations for appropriate documentation and conservation are <br /> evaluated by the Lead Agency. Excavation or disturbance may continue in other areas of <br /> the site that are not reasonably suspected to overlie adjacent or additional <br /> paleontological resources. <br /> Implementation Measure 1 for MM 4.D-3. Prior to issuance of preliminary grading <br /> permits, the project applicant shall incorporate all recommendations provided in the <br /> appended Geotechnical Engineering Report into project plans. The Geotechnical <br /> recommendations outlined on page 6 through page 17 of the Geotechnical Exploration <br /> that shall be implemented include foundation systems, earthwork recommendations for <br /> site preparation, subgrade preparation, fill materials, compaction, grading, drainage, and <br /> construction, shallow foundations, floor slab, seismic considerations, lateral earth <br /> pressures, and pavements. <br /> Implementation Measure 2 for MM 4.13-3. The project applicant shall hire a qualified <br /> geotechnical firm to conduct a design-level geotechnical study. The design-level study <br /> shall incorporate further recommendations that will reduce impacts resulting from <br /> expansive soils to the greatest extent possible. Prior to issuance of preliminary grading <br /> permits, the project applicant shall incorporate all recommendations provided in the <br /> design-level geotechnical study into the project plans. <br /> Implementation Measure 3 for MM 4.D-3. The project applicant shall obtain a qualified <br /> paleontologist to monitor all ground-disturbing activities in previously undisturbed areas <br /> at the project site. Procedures for handling potential paleontological resources <br /> encountered are included in Prior EIR MM 3. <br /> MM 4.D-4. In the event that human remains are discovered during grading and <br /> construction of development facilities by the Housing Element, work shall stop <br /> immediately. There shall be no disposition of such human remains, other than in <br /> accordance with the procedures and requirements set forth in California Health and <br /> Safety Code Section 7050.5 and Public Resources Section 5097.98. These code <br /> provisions require notification of the County Coroner and the Native American Heritage <br /> Commission, who in turn must notify the persons believed to be most likely descended <br /> from the deceased Native American for appropriate disposition of the remains. <br />
