RESOLUTION NO. 23-1382 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON TERMINATING THE LOCAL DROUGHT EMERGENCY, THE STAGE 2 WATER SHORTAGE AND THE STAGE 2 DROUGHT RATES WHEREAS, on October 5, 2021, Council adopted Ordinance No. 2225 declaring a local drought emergency due to the critically reduced water supplies and continued extreme dry weather for the protection of public health, safety, and welfare; and WHEREAS, on March 24, 2023, Governor Newsom issued EO N-5-23 which ended the voluntary 15 percent statewide water conservation target and the requirement that water suppliers implement Level 2 of their drought contingency plans; and WHEREAS, Zone 7 Board of Directors will discuss ending their drought emergency and mandatory conservation at their meeting on April 19, 2023; and WHEREAS, it is anticipated that the Zone 7 Board of Directors will end their drought emergency and mandatory conservation at their April 19, 2023 meeting; and WHEREAS, the proclaimed local drought emergency per Ordinance No. 2225 is to be terminated upon approval of Zone 7's Board of Directors to end Zone 7's drought emergency and mandatory conservation anticipated on April 19, 2023. WHEREAS, the Stage 2 water shortage and mandatory 15 percent reduction in water usage per Resolution 21-1250 and the Stage 2 drought rates per Resolution 22-1283 are to be terminated upon approval of Zone 7's Board of Directors to end Zone 7's drought emergency and mandatory conservation anticipated on April 19, 2023. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1. Finds that the termination of the local drought emergency, the Stage 2 water shortage and the Stage 2 drought rates comply with the State's termination of their drought emergency and upon the anticipated approval of Zone 7's termination of their drought emergency and mandatory conservation. SECTION 2. Terminates the local drought emergency described in Ordinance No 2225 upon approval of Zone 7's Board of Directors to end Zone 7's drought emergency and mandatory conservation anticipated on April 19, 2023. SECTION 3. Terminates the Stage 2 water shortage described in Resolution 21-1250 and ends the Stage 2 drought rates as provided in Resolution 21-1283 upon approval of Zone 7's Board of Directors to end Zone 7's drought emergency and mandatory conservation anticipated on April 19, 2023. PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at a regular meeting held on April 18, 2023.
