traveled way of the public street nor into the drainage ditches, gutters or <br />other drainage facilities. <br /> <br /> The general public may not be denied the use of the planted area for <br />pedestrian or other lawful travel. The City may use the planted area for <br />any purpose whatever, and may issue a permit to any applicant to go there- <br />on to perform work or otherwise encroach pursuant to this ordinance. If <br />the lawn is damaged or disturbed in the course of any authorized encroach- <br />ment, it will be removed and replaced by the permittee unless the permit <br />specif~ ally states otherwise. <br /> <br /> 3023. IRRIC~TION SYSTEMS. No portion of any irrigation system shall <br />extend above the level of the surrounding ground or pavement. No irrigation <br />system shall be installed in such a way as to direct sprays or streams of water <br />onto or over adjacent street, sidewalk or driveway areas. <br /> <br /> 3024. PRESERVATION OF MONUMENTS. Any monument of granite, concrete, <br />iron or other lasting material set for the purpose of locating or preserv- <br />ing the limes and/or elevation of any public street or right-of-way, property <br />subdivision or a precise survey point or reference point shall not be re- <br />moved or disturbed without first obtaining permission from the Superintendent <br />of Streets to do so, said permission to be granted in conformance with require- <br />ments as set forth in~'.specifications established by the Superintendent of <br />Streets. Replacement of removed or disturbed monument will be at the exper~ <br />of the permittee. <br /> <br /> 3025. MAPS OF FACILITIES. Each permittee installing, constructing, <br />or maintaining underground facilities, such as pipes, wires, conduits, or <br />similar structures, shall maintain accurate and complete maps of such facili- <br />ties. The Superintendent of Streets shall be furnished, at no cost to the <br />City, information regarding location, size, and character of such faciliti~s, <br />either by sketches or maps, as may be necessary from time to time. <br /> <br /> 3026. PUBLIC SERVICE DIRECTIONAL SIGNS. Public service directional <br />signs for churches, hospitals and similar places of public use may not be <br />erected, placed or maintained within a right-of-way without first obtaining <br />a permit hereunder. The City Council may, from time to time, adopt by reso- <br />lution special regulatiom~ and fee schedules pertaining to encroachment by <br />such signs. <br /> <br />3027. EXCAVATION OF NEWLY PAVED STREETS. <br /> <br /> 3027.01 The Superintendent of Streets shall encourage private per- <br />sons and public agencies to complete all maintenance and new construction <br />before a street or other right-of-way is improved or newly paved. He shall <br />scrutinize closely, and be firm in granting variances to these provisions <br />upon receiving applications for encroachments on newly paved streets. <br /> <br />4001. APPEALS. <br /> <br /> 4001.01 Right of Appeal. Any person aggrieved by the action of any <br />administrative official of the City acting under this ordinance may appeal <br />said decision to the City Council. <br /> <br /> 4001.02 Method of Filing Appeal. Said aggrieved person shall file <br />notice in writing with the City Clerk within seven (7) days after final <br />~action of the administrative official whose action is being appealed. <br /> <br /> 4001.03 Action of City Council. The City Council may affirm, modi- <br />fy or reverse the action of the administrative official from whom the appeal <br />is taken. <br /> <br /> 4002. PENALTIES. Any person, firm or corporation, whether acting <br />as principal, agent or employee, who violates or causes the violation of <br />any of the provisions of this ordinance shall be guilty of a misdemeanor. <br /> <br /> <br />
