ATTACHMENT 2 <br /> MEMORANDUM OF UNDERSTANDING <br /> FOR ENVIRONMENTAL REVIEW LEAD AGENCY <br /> (TRI-VALLEY HAVEN EMERGENCY SHELTER REBUILD PROJECT) <br /> THIS MEMORANDUM OF UNDERSTANDING is entered into this day of <br /> 2023, between the City of Livermore, a municipal corporation and the <br /> City of Pleasanton, a municipal corporation. <br /> WHEREAS the City of Livermore and City of Pleasanton cooperate in <br /> performing environmental reviews within the city limits of Livermore for Federally <br /> funded or assisted projects in accordance with the National Environmental Policy Act, <br /> 24 CFR Part 58 and the related laws and authorities listed at Sections 58.5 and 58.6 <br /> ("NEPA Requirements"); <br /> WHEREAS the City of Livermore and City of Pleasanton are both providing <br /> Community Development Block Grant (CDBG) funds in the amounts of $483,846 and <br /> $250,000, respectively, for a proposed demolition and rebuilding of Tri Valley Haven's <br /> Emergency Shelter at a confidential location in Livermore, CA 94550 ("Project"); and <br /> WHEREAS the parties desire to establish the role and responsibilities of lead <br /> agency and cooperating agency with respect to NEPA Requirements for this Project; <br /> NOW, THEREFORE, the parties hereby agree as follows: <br /> 1. Lead Agency/Cooperating Agency. City of Livermore shall be the lead <br /> agency and the City of Pleasanton shall be the cooperating agency entity with respect <br /> to the environmental review, decision-making and action responsibilities pursuant to <br /> the National Environmental Policy Act, 24 CFR Part 58 and the related laws and <br /> authorities listed at Sections 58.5 and 58.6. <br /> 2. Lead Agency Responsibilities. City of Livermore shall take lead <br /> responsibility for assessing and resolving environmental impacts on the Project solely <br /> with respect to NEPA Requirements. <br /> 3. Cooperating Agency Responsibilities. City of Pleasanton shall provide all <br /> necessary assistance to facilitate and ensure City of Livermore's compliance with <br /> NEPA Requirements. <br /> 4. Consultant Costs. The City of Livermore or City of Pleasanton shall <br /> equally share the cost for any NEPA consultant cost associated with the Project. <br /> 5. Termination; Amendments. City of Livermore or City of Pleasanton may <br /> end or terminate this Memorandum of Understanding at any time with prior written <br /> notice. This Memorandum of Understanding may be amended from time to time by <br /> written agreement by City of Livermore and the City of Pleasanton. <br /> 1 <br />
