RESOLUTION NO. 23-1377 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON APPROVING THE AFFORDABLE HOUSING AGREEMENT BETWEEN THE CITY OF PLEASANTON AND STONERIDGE PROPERTIES LLC AS FILED UNDER CASE NO. PUD-136 WHEREAS, Stoneridge Properties LLC (also referred to as Simon Property Group LP) has made an application to the City for an Affordable Housing Agreement for the construction of 360 multi-family apartment units on a parcel commonly known as 1008 Stoneridge Mall Road, as filed under Case No. PUD-136 (the "Project'); and WHEREAS, the Housing Commission reviewed and recommended approval of the Affordable Housing Agreement for the Project at its meeting of November 17, 2022; and WHEREAS, a duly-noticed public hearing was held by the City Council on March 21, 2023, at which time the public was given the opportunity to comment on the Affordable Housing Agreement; and WHEREAS, there was prepared for the Project a Section 15183 Checklist / 15164 Addendum to the Supplemental Environmental Impact Report (SEIR) and adopted Findings and Statement of Overriding Considerations for the Pleasanton 2007-2014 Housing Element Update and Climate Action Plan General Plan Amendments and Rezonings (State Clearinghouse No. 2011052002), which was a supplement to the Pleasanton General Plan Update 2005-2025 Program Environmental Impact Report (State Clearinghouse No. 205122139). NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1. Finds that the Section 15183 Checklist/ 15164 Addendum to the SEIR for the Pleasanton 2007-2014 Housing Element and Climate Action Plan General Plan Amendment and Rezoning, including the adopted CEQA Findings and Statement of Overriding Considerations, is adequate to serve as the environmental documentation for this Project and the Affordable Housing Agreement and satisfies all the requirements of CEQA. SECTION 2. Approves the Affordable Housing Agreement between the City of Pleasanton and Stoneridge Properties LLC, a copy of which is attached hereto as Exhibit A and incorporated herein by this reference; and authorizes the City Manager to execute the Affordable Housing Agreement in generally the form as attached in Exhibit A, subject to minor amendments and approval by the City Attorney. SECTION 3. This resolution shall become effective upon the effective date of the ordinance approving PUD-136. PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at a regular meeting held on March 21, 2023.
