<br />uncovered fossils are properly assessed by a qualified Paleontologist and subsequent <br />recommendations for appropriate documentation and conservation are evaluated by the Lead <br />Agency. Excavation or disturbance may continue in other areas of the site that are not reasonably <br />suspected to overlie adjacent or additional paleontological resources. <br /> <br />Implementation Measure 1 for MM 4.D-3. Prior to issuance of preliminary grading permits, the <br />project applicant shall incorporate all recommendations provided in the appended Geotechnical <br />Engineering Report into project plans. The Geotechnical recommendations outlined on page 6 <br />through page 17 of the Geotechnical Exploration that shall be implemented include foundation <br />systems, earthwork recommendations for site preparation, subgrade preparation, fill materials, <br />compaction, grading, drainage, and construction, shallow foundations, floor slab, seismic <br />considerations, lateral earth pressures, and pavements. <br /> <br />Implementation Measure 2 for MM 4.D-3. The project applicant shall hire a qualified <br />geotechnical firm to conduct a design-level geotechnical study. The design-level study shall <br />incorporate further recommendations that will reduce impacts resulting from expansive soils to <br />the greatest extent possible. Prior to issuance of preliminary grading permits, the project applicant <br />shall incorporate all recommendations provided in the design-level geotechnical study into the <br />project plans. <br /> <br />Implementation Measure 3 for MM 4.D-3. The project applicant shall obtain a qualified <br />paleontologist to monitor all ground-disturbing activities in previously undisturbed areas at the <br />project site. Procedures for handling potential paleontological resources encountered are <br />included in Prior EIR MM 3. <br /> <br />MM 4.D-4. In the event that human remains are discovered during grading and construction of <br />development facilities by the Housing Element, work shall stop immediately. There shall be no <br />disposition of such human remains, other than in accordance with the procedures and <br />requirements set forth in California Health and Safety Code Section 7050.5 and Public Resources <br />Section 5097.98. These code provisions require notification of the County Coroner and the Native <br />American Heritage Commission, who in turn must notify the persons believed to be most likely <br />descended from the deceased Native American for appropriate disposition of the remains. <br /> <br />MM 4.L-2. Prior to the recordation of a Final Map, the issuance of a grading permit, the issuance <br />of a building permit, or utility extension approval to the site, whichever is sooner, the applicant <br />shall submit written verification from Zone 7 Water Agency or the City of Pleasanton’s Utility <br />Planning Division that water is available for the project. To receive the verification, the applicant <br />may need to offset the project’s water demand. This approval does not guarantee the availability <br />of sufficient water capacity to serve the project. <br /> <br />Implementation Measure 1 for MM 4.L-2. Prior EIR MM 4.L-2 shall be implemented as follows: <br />the project applicant shall pay the project’s pro-rata share of the cost to increase reservoir <br />capacity for the project’s increase in water storage demand of approximately 0.1 MG, to be paid <br />prior to building permit issuance. <br /> <br />MM 4.J-1. In addition to requiring that all project developers comply with the applicable <br />construction noise exposure criteria established within the City’s Municipal Code 9.04.100, the <br />City shall require developers on the potential sites for rezoning to implement construction best <br />management practices to reduce construction noise, including: <br />a. Locate stationary construction equipment as far from adjacent occupied buildings as <br />possible.
