RESOLUTION NO. PC-2023-06 <br />A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RECOMMENDING CITY COUNCIL ADOPTION OF A CALIFORNIA ENVIRONMENTAL QUALITY <br />ACT (CEQA) ADDENDUM AND A PLANNED UNIT DEVELOPMENT (PUD) DEVELOPMENT <br />PLAN FOR THE APPLICATION OF SIMON PROPERTY GROUP <br />AS FILED UNDER CASE NO. PUD-136 <br />WHEREAS, on May 29 , 2019, Simon Property Group ("Applicant") submitted an application <br />for a Planned Unit Development (PUD) Development Plan approval to construct 360 multi-family <br />apartment units and related site improvements including a new parking structure (the "Project") on <br />real property commonly known as 1008 Stoneridge Mall Road consisting of portions of Assessor <br />Parcel Numbers 941-1201-94-03 and 941-1201-04-06 (the "Property"); and <br />WHEREAS, the Project was subject to the Supplemental Environmental Impact Report <br />(SEIR) and California Environmental Quality Act (CEQA) Findings and a Statement of Overriding <br />Considerations for the Housing Element Update and Climate Action Plan General Plan Amendment <br />and Rezonings certified and adopted by the City Council on January 4 , 2012 ; and that SEIR was a <br />supplement to the El R prepared for the Pleasanton 2005-2025 General Plan which was certified on <br />in July 2009 ; further , the Property was one of 21 potential housing sites analyzed in the SEIR and is , <br />therefore , within its scope of review, and the SEIR included some mitigation measures that needed <br />to be addressed prior to issuance of a building permit for a project , and these mitigation measures <br />have been addressed in the Conditions of Approval for the Project; and <br />WHEREAS, the City prepared an Addendum to the SEIR and EIR for the City of Pleasanton <br />Housing Element and Climate Action Plan General Plan Amendment and Rezonings, which <br />evaluated the Project and concluded that none of the circumstances referenced in CEQA Guidelines <br />15183 or 15162 have occurred (Addendum); and <br />WHEREAS, the Property is designated Mixed Use in the General Plan; and <br />WHEREAS, the Property is designated PUD-MU (Planned Un it Development-Mixed Use) <br />on the City's zoning map ; and <br />WHEREAS, on March 11 , 2020, the Planning Commission , following public notice, <br />conducted a work session regarding the Project; and <br />WHEREAS, the City of Pleasanton is the lead agency on the Project , and the City Council is <br />the decision-making body for the proposed approval of the Project; and <br />WHEREAS , at its duly noticed public meeting of February 22 , 2023 , the Planning <br />Commission considered the written agenda report , all public testimony, relevant exhibits , and staff <br />recommendations. <br />NOW, THEREFORE BE IT RESOLVED by the Planning Commission of the City of Pleasanton , <br />based on the entire record of proceedings , including the oral and written agenda reports and all <br />public comment and testimony : <br />Section 1. Finds it has independently reviewed and analyzed the Addendum and other <br />information in the record , including the EIR as supplemented by the SEIR, and has considered the <br />information contained therein, prior to recommending approval of the Project; the Addendum has
