Our team's collaboration with staff has resulted in <br /> what we believe is a model for the type of high-density development the Council will be seeking <br /> as the City builds out the housing proposed in its recently adopted 6th Cycle Housing Element. <br /> I am writing to ensure the Council is aware that this project is subject to several laws that limit its <br /> discretion. Specifically, SPG was concerned by suggestions by some Planning Commissioners <br /> that the project be modified to include a wider multi-use path along Stoneridge Mall Road, which <br /> cannot lawfully be required. Similarly, at least one Commissioner suggested shifting the <br /> apartment building as many as 15 feet north to make room for a wider path along the southern <br /> edge, which cannot be accomplished because it would require this residential building to extend <br /> beyond the boundary of the property the City has zoned to allow residential uses. <br /> There was also a request that the project be compared to the Objective Design Standards <br /> (ODS) and Framework Components the Council enacted on January 26, 2023, and some <br /> Commissioners suggested modifying the project to be consistent with those documents. As <br /> staff has consistently advised, these new standards do not apply to the project, and the City <br /> cannot lawfully require the project to conform to these inapplicable standards. <br /> For your reference, we attach an Addendum to this letter identifying and explaining how the <br /> provisions of certain housing and other laws support these conclusions. <br /> Perkins Cue LLP <br />
