RESOLUTION NO. 23-1371 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DECLARING THAT WEEDS, DIRT, RUBBISH, AND REFUSE UPON OR IN FRONT <br /> OF CERTAIN DESCRIBED PROPERTIES WITHIN THE CITY OF PLEASANTON <br /> CONSTITUTE PUBLIC NUISANCES AND THAT THEY BE ABATED, AND SETTING <br /> A PUBLIC HEARING REGARDING THE ABATEMENT <br /> WHEREAS, there is attached hereto and incorporated by reference herein as if fully set <br /> forth a list of properties to which this resolution applies as Exhibit A; and <br /> WHEREAS, said list of properties specifically sets forth street, lot and block numbers <br /> according to the official assessment map for each piece of property; and <br /> WHEREAS, the properties listed have, upon or in front of them, weeds, as defined by <br /> Section 39561.5 of the Government Code, dirt, rubbish, or refuse; and <br /> WHEREAS, said weeds, dirt, rubbish, and refuse are a public nuisance in that they <br /> constitute a fire hazard, or that said materials are noxious or dangerous and as such, are <br /> detrimental to the health, safety and welfare of the City of Pleasanton and, as such, shall be <br /> removed; and <br /> WHEREAS, the public nuisances referred to herein are recurrent and seasonal in <br /> nature. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. That the weeds, dirt, rubbish and refuse upon on or in front of the <br /> properties described in Exhibit A, are declared a public nuisance and are to be abated and <br /> removed pursuant to the procedure provided by Section 39560-39588 of the Government Code. <br /> SECTION 2. A public hearing shall be held Tuesday, April 18, 2023, at 7:00 p.m. at <br /> which time property owners having objections to the proposed removal of weeds, rubbish, <br /> refuse and dirt will be heard and given due consideration. <br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at <br /> a regular meeting held on March 07, 2023. <br /> I, Jocelyn Kwong, City Clerk of the City of Pleasanton, California, certify that the <br /> foregoing resolution was adopted by the City Council at a regular meeting held on the 7th day of <br /> March 2023 by the following vote: <br /> Ayes: Councilmembers Arkin, Balch, Nibert, Testa, Mayor Brown <br /> Noes: None <br /> Absent: None <br /> Abstain: None <br /> .a <br /> J c lyn K ong ity Clerk <br /> APPR VED S TO FORM: <br /> Daniel G.
