RESOLUTION NO. 23-1369 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON AUTHORIZING THE CITY MANAGER, ASSISTANT CITY MANAGER, AND DIRECTOR OF FINANCE, ON BEHALF OF THE CITY, TO BE THE AUTHORIZED AGENTS TO ENGAGE WITH THE FEDERAL EMERGENCY MANAGEMENT AGENCY (FEMA)AND THE CALIFORNIA GOVERNOR'S OFFICE OF EMERGENCY SERVICES (CAL OES) REGARDING DISASTER RELIEF FOR SEVERE WINTER 2022-2023 STORMS, AND ANY FUTURE DISASTERS FOR THE NEXT THREE YEARS WHEREAS, from December 31, 2022 through early January 2023, severe storms and atmospheric river systems resulted in widespread flooding, wind damage and property damage in Pleasanton and across California; and WHEREAS, on January 9, 2023, the City Manager, acting as Director of Emergency Services pursuant to Municipal Code Chapter 2.44, declared a local emergency due to these severe winter 2022-2023 storms (the "storms"); and WHEREAS, the City Council ratified this declaration of local emergency due to storms by Resolution No. 23-1351 on January 11, 2023; and WHEREAS, the governor proclaimed a state of emergency throughout California due to these storms on January 4, 2023; and WHEREAS, a Presidential Major Disaster Declaration was made on January 14, 2023, to support California's emergency response to these storms; and Alameda County was added as a location included in this federal declaration on February 2, 2023, making funding available to local governments, including the City of Pleasanton and other jurisdictions, to address costs incurred and damages arising from these storms; and WHEREAS, to ensure the health and safety of its citizens during these storms, the City of Pleasanton has incurred significant unbudgeted costs and anticipates additional costs to repair damaged public facilities and improvements caused by these storms; and WHEREAS, the City of Pleasanton will see public assistance pursuant to Title 44 Code of Federal Regulations §§200 et. seq., which is one of the Federal Emergency Management Agency's (FEMA) federal disaster assistance programs available with the Presidential Major Disaster Declaration regarding these storms; and WHEREAS, the main sources for disaster financial assistance are the state and federal government; these sources include, but are not limited, to FEMA Public Assistance (PA) funding, which is administered by the California Governor's Office of Emergency Services (CAL OES); and WHEREAS, in order to obtain certain federal and state financial assistance related to these storms, CAL OES requires the City to formally designate by resolution Authorized Agents to execute applications, agreements, and other actions pertaining to disaster relief with CAL OES; and such authorization can extend for three years for any future disasters. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING:
