RESOLUTION NO. 23-1367 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON MODIFYING THE MASTER FEE SCHEDULE TO ADOPT APPLICATION FEES FOR SENATE BILL 330 PRELIMINARY REVIEW AND HOUSING SITE COMPLIANCE REVIEW WHEREAS, on October 9, 2019, Governor Newsom signed the Housing Crisis Act of 2019 into law, commonly known as Senate Bill 330, to address the Statewide housing shortfall with new protections for existing housing and restrictions on certain zoning actions that reduce the availability of housing, and expedite and increase certainty in the development process, including establishing a new preliminary review process for applications; and WHEREAS, on January 26, 2023, the City Council adopted the 6th Cycle Housing Element, including Program 4.8 and Housing Sites Objective Design Standards which established a streamlined review process for development of housing sites; and WHEREAS, City Council policy includes a requirement that applicants shall submit the applicable permit application fee established by City Council resolution; and WHEREAS, the City now wishes to establish Planning Division application fees of $1,494.00 for Senate Bill 330 Preliminary Review, $9,315.00 for Housing Site Compliance Review - Zoning Administrator (50 units or less), and $10,250.00 for Housing Site Compliance Review - Planning Commission (51 units or more), subject to an annual inflation adjustment on January 15t of each year based upon the Engineering News Record Construction Cost Index for the San Francisco-Bay Area; and WHEREAS, staff has determined these fees are reasonable based on an estimate of anticipated staff time necessary to process Senate Bill 330 Preliminary Review and Housing Site Compliance Review applications in a timely manner. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1. Section II (B) of the Master Fee Schedule is amended to incorporate a Planning Division application fee for Senate Bill 330 Preliminary Review; Housing Site Compliance Review - Zoning Administrator review, and Housing Site Compliance Review - Planning Commission review, as provided in Exhibit A. SECTION 2. This resolution shall become effective 60 days after its adoption. SECTION 3. City Clerk shall certify to the passage of this resolution and enter it into the book of original resolutions. PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at a regular meeting held on February 21, 2023.
