Box 520 <br /> Pleasanton, CA 94566 <br /> Recording requested Pursuant to <br /> Government Code Sections <br /> No Fee-27383&6103 <br /> APN: 941-1311-21 <br /> GRANT OF EASEMENT <br /> THIS GRANT OF EASEMENT is made and entered into this day of 2022 by and <br /> between William Steven Wheeler, Trustee of the 2014 William Steven Wheeler Revocable Trust U/D/T/ <br /> May 1, 2014 ("Grantor") and the City of Pleasanton ("Grantee"). <br /> For valuable consideration, receipt of which is acknowledged, Grantor grants to Grantee a permanent <br /> easement and right of way for roadway,sidewalk and landscaping purposes, including the right to construct, <br /> replace, inspect, maintain, repair, operate or remove a roadway, supporting columns, walls and footings, <br /> sidewalks, pathways, landscaping including any and all appurtenances thereto, over, under, upon and <br /> across the following described real property situated in the City of Pleasanton, County of Alameda, State <br /> of California, described as follows: <br /> Exhibits"A"and"B" attached hereto and made a part hereof. <br /> The Grantor reserves the right to use the easement parcel for all purposes not inconsistent with the <br /> easement. However, such use by the Grantor shall not include the construction of permanent structures, <br /> including but not limited to buildings, retaining walls, decks, patios, or other concrete structures within the <br /> easement. <br /> Grantee agrees upon completion of any of its construction hereunder to restore as near as possible the <br /> surface of the ground to the condition in which it was prior to the commencement of said construction. <br /> This instrument shall run with the land and inure to the benefit of the successors and assigns of the parties <br /> hereto. <br /> IN WITNESS WHEREOF, the parties hereto have entered into this Grant of Easement as of the day and <br /> year set forth above. <br />
