Box 520 Pleasanton, CA 94566 Recording requested Pursuant to Government Code Sections No Fee-27383 &6103 APN: 941-1311-21 GRANT OF EASEMENT THIS GRANT OF EASEMENT is made and entered into this -30 day of,�"Rr+�VA 2023 by and between William Steven Wheeler, Trustee of the 2014 1lVlliam Steven Wheeler Revocable Trust U/DM May 1, 2014("Grantor")and the City of Pleasanton("Grantee"). For valuable consideration, receipt of which is acknowledged, Grantor grants to Grantee a permanent easement and right of way for roadway,sidewalk and landscaping purposes, including the right to construct, replace, inspect, maintain, repair, operate or remove a roadway, supporting columns, walls and footings, sidewalks, pathways, landscaping including any and all appurtenances thereto, over, under, upon and across the following described real property situated in the City of Pleasanton, County of Alameda, State of California,described as follows: Exhibits"A"and"B"attached hereto and made a part hereof. The Grantor reserves the right to use the easement parcel for all purposes not inconsistent with the easement. However, such use by the Grantor shall not include the construction of permanent structures, including but not limited to buildings, retaining wails, decks, patios, or other concrete structures within the easement. Grantee agrees upon completion of any of its construction hereunder to restore as near as possible the surface of the ground to the condition in which it was prior to the commencement of said construction. This instrument shall run with the land and inure to the benefit of the successors and assigns of the parties hereto. IN WITNESS WHEREOF, the parties hereto have entered into this Grant of Easement as of the day and year set forth above.
