THE CITY OF <br /> CITY COUNCIL AGENDA REPORT <br /> PLEASANTON. <br /> March 7, 2023 <br /> Engineering <br /> TITLE: APPROVE THE FINAL TWO PURCHASE AGREEMENTS TO ACQUIRE <br /> THE PUBLIC RIGHT-OF-WAY NEEDED TO CONSTRUCT THE TRAFFIC <br /> MITIGATION MEASURES FOR THE JOHNSON DRIVE ECONOMIC <br /> DEVELOPMENT ZONE PROJECT, CIP NO. 21596 <br /> SUMMARY <br /> The City is required to acquire the right-of-way needed to construct the Johnson Drive <br /> Economic Development Zone (JDEDZ) Project's traffic mitigation measures identified in <br /> the project's environmental documentation. Acquisition of the right-of-way needed from <br /> one of 10 properties on Johnson Drive affected by the JDEDZ Project was completed in <br /> September 2021. Acquisition of the right-of-way needed from seven more of the <br /> affected properties was accomplished in July 2022. Negotiation with each of the final <br /> two property owners is now complete. The negotiated purchase price for the two <br /> properties combined, including estimated title insurance and escrow fees, totals <br /> $229,762. Since the negotiated purchase price for each property is similar to the <br /> property appraisals and consistent with the amount paid for the right-of-way needed <br /> from other properties on Johnson Drive, staff believes the negotiated costs to be fair <br /> and reasonable. The JDEDZ ROW and Misc. Project, CIP No. 21596, was created to <br /> fund the purchase of most of the right-of-way needed for the JDEDZ Project, including <br /> the right-of-way represented by these final two purchase agreements. However, the <br /> previous right-of-way purchases, as well as some other minor miscellaneous project <br /> expenses, have reduced the balance available in CIP No. 21596 to $44,124. It is <br /> recommended the City Council approve the final two purchase agreements, which will <br /> allow for all improvements included in the JDEDZ Traffic Mitigation Measures <br /> Improvement Plans to be constructed, as well as approve the transfer of $190,000 from <br /> the Dublin Freeway Reimbursement Reserve, CIP No. 98590, to the JDEDZ ROW & <br /> Misc. Project, CIP No. 21596, to fully fund the purchase of the right-of-way in <br /> accordance with the terms of the purchase agreements, as well as provide the ability to <br /> pay for other minor miscellaneous expenses should it be necessary. <br /> RECOMMENDATION <br /> 1. Approve the two purchase agreements for the right-of-way necessary to construct <br /> the work as shown on the JDEDZ Traffic Mitigation Measures Improvement Plans. <br /> 2. Approve the transfer of $191,000 from the Dublin Freeway Reimbursement Reserve, <br /> CIP No. 98590 to the JDEDZ ROW and Misc., CIP No. 21596, to fully fund the right- <br /> of-way purchases in accordance with the terms in the two agreements. <br />
