AUGUSTIN BERNAL MOUNTAIN BIKE TRAIL PROJECT DRAFT INITIAL STUDY <br /> 12956 <br />DUDEK 82 April 2022 <br /> No known tribal cultural resources that are listed or eligible for listing in the California <br />Register of Historical Resources, or in a local register of historical resources as defined in <br />PRC Section 5020.1(k) have been identified through the AB 52 notification process or the <br />cultural resources investigation conducted on the project site. However, as discussed in <br />Section 3.5(b), there is a potential to encounter cultural resources, including tribal cultural <br />resources, during project construction. Evaluation and protection measures for potential <br />discoveries of tribal cultural resources are identified in MM-CUL-1. With implementation of <br />MM-CUL-1, impacts to tribal cultural resources would be less than significant. Therefore, <br />impacts would be less than significant with mitigation incorporated. <br />ii) A resource determined by the lead agency, in its discretion and supported by substantial <br />evidence, to be significant pursuant to criteria set forth in subdivision (c) of Public <br />Resources Code Section 5024.1. In applying the criteria set forth in subdivision (c) of <br />Public Resource Code Section 5024.1, the lead agency shall consider the significance of <br />the resource to a California Native American tribe? <br />No tribal cultural resources, as defined in PRC Section 21074, have been identified within <br />the project site or in its immediate vicinity to date. It is possible that ground disturbing <br />activities associated with the project, such as grading, could uncover previously <br />undiscovered tribal cultural resources. Implementation of MM-CUL-1 would ensure that <br />appropriate protocol and BMPs are followed to ensure appropriate evaluation and <br />treatment of any tribal cultural resources that may be uncovered during construction <br />activities and that project impacts to tribal cultural resources would be less than <br />significant.
