AUGUSTIN BERNAL MOUNTAIN BIKE TRAIL PROJECT DRAFT INITIAL STUDY 12956 DUDEK 82 April 2022 No known tribal cultural resources that are listed or eligible for listing in the California Register of Historical Resources, or in a local register of historical resources as defined in PRC Section 5020.1(k) have been identified through the AB 52 notification process or the cultural resources investigation conducted on the project site. However, as discussed in Section 3.5(b), there is a potential to encounter cultural resources, including tribal cultural resources, during project construction. Evaluation and protection measures for potential discoveries of tribal cultural resources are identified in MM-CUL-1. With implementation of MM-CUL-1, impacts to tribal cultural resources would be less than significant. Therefore, impacts would be less than significant with mitigation incorporated. ii) A resource determined by the lead agency, in its discretion and supported by substantial evidence, to be significant pursuant to criteria set forth in subdivision (c) of Public Resources Code Section 5024.1. In applying the criteria set forth in subdivision (c) of Public Resource Code Section 5024.1, the lead agency shall consider the significance of the resource to a California Native American tribe? No tribal cultural resources, as defined in PRC Section 21074, have been identified within the project site or in its immediate vicinity to date. It is possible that ground disturbing activities associated with the project, such as grading, could uncover previously undiscovered tribal cultural resources. Implementation of MM-CUL-1 would ensure that appropriate protocol and BMPs are followed to ensure appropriate evaluation and treatment of any tribal cultural resources that may be uncovered during construction activities and that project impacts to tribal cultural resources would be less than significant. Therefore, impacts would be less than significant with mitigation incorporated.
