RESOLUTION NO. 23-1363 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON ADOPTING <br /> A MITIGATED NEGATIVE DECLARATION FOR THE AUGUSTIN BERNAL MOUNTAIN <br /> BIKE TRAIL PROJECT, CIP NO. 20771 <br /> WHEREAS, on May 7, 2019, the City of Pleasanton adopted the Trails Master Plan, which <br /> proposed the Augustin Bernal Mountain Bike Trail project; and <br /> WHEREAS, the City Council prioritized the project during the fiscal year 2019/20 funding <br /> process; and <br /> WHEREAS, the City of Pleasanton is the lead agency on the Project, and the City Council <br /> is the decision-making body for the proposed approval to carry out the Project; and <br /> WHEREAS, the Project is subject to review under the California Environmental Quality <br /> Act (CEQA), and an Initial Study and Mitigated Negative Declaration have been prepared in <br /> accordance with Sections 15070 and 15072 of the CEQA Guidelines; and <br /> WHEREAS, the Initial Study concluded that the implementation of the Project with <br /> mitigations would not result in any significant impacts to the environment; and <br /> WHEREAS, on April 30, 2022, Notice of Intent (NOI) to Adopt a Draft Initial Study and <br /> Proposed Negative Declaration were sent to interested parties and property owners/residents in <br /> accordance with CEQA Guidelines Section 15072; and <br /> WHEREAS, at a duly noticed public hearing on February 7, 2023, the City Council <br /> received and reviewed the Initial Study, dated April 2022, received the recommendation of City <br /> staff, and the public was given the opportunity to comment on the environmental impacts of the <br /> Project; and <br /> WHEREAS, the City Council has reviewed and considered the Initial Study/ Mitigated <br /> Negative Declaration and intends to take actions on the Project in compliance with CEQA. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. The City Council does hereby make the following findings: (1) it has <br /> independently reviewed and analyzed the Initial Study/ Mitigated Negative Declaration and other <br /> information in the record and has considered the information contained therein, prior to acting <br /> upon or approving the Project; (2) the Initial Study/ Mitigated Negative Declaration prepared for <br /> the Project has been completed in compliance with CEQA; and (3) the Initial Study/ Mitigated <br /> Negative Declaration represents the independent judgment and analysis of the City of Pleasanton <br /> as lead agency for the Project. <br /> SECTION 2. The City Council does find that based upon the entire record of proceedings <br /> before it and all information received that there is no substantial evidence that the Project, as <br /> mitigated, will have a significant effect on the environment and does hereby approve and adopt <br /> the Mitigated Negative Declaration prepared for the Project (CIP No. 20771). <br />
