RESOLUTION NO. 23-1363 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON ADOPTING A MITIGATED NEGATIVE DECLARATION FOR THE AUGUSTIN BERNAL MOUNTAIN BIKE TRAIL PROJECT, CIP NO. 20771 WHEREAS, on May 7, 2019, the City of Pleasanton adopted the Trails Master Plan, which proposed the Augustin Bernal Mountain Bike Trail project; and WHEREAS, the City Council prioritized the project during the fiscal year 2019/20 funding process; and WHEREAS, the City of Pleasanton is the lead agency on the Project, and the City Council is the decision-making body for the proposed approval to carry out the Project; and WHEREAS, the Project is subject to review under the California Environmental Quality Act (CEQA), and an Initial Study and Mitigated Negative Declaration have been prepared in accordance with Sections 15070 and 15072 of the CEQA Guidelines; and WHEREAS, the Initial Study concluded that the implementation of the Project with mitigations would not result in any significant impacts to the environment; and WHEREAS, on April 30, 2022, Notice of Intent (NOI) to Adopt a Draft Initial Study and Proposed Negative Declaration were sent to interested parties and property owners/residents in accordance with CEQA Guidelines Section 15072; and WHEREAS, at a duly noticed public hearing on February 7, 2023, the City Council received and reviewed the Initial Study, dated April 2022, received the recommendation of City staff, and the public was given the opportunity to comment on the environmental impacts of the Project; and WHEREAS, the City Council has reviewed and considered the Initial Study/ Mitigated Negative Declaration and intends to take actions on the Project in compliance with CEQA. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1. The City Council does hereby make the following findings: (1) it has independently reviewed and analyzed the Initial Study/ Mitigated Negative Declaration and other information in the record and has considered the information contained therein, prior to acting upon or approving the Project; (2) the Initial Study/ Mitigated Negative Declaration prepared for the Project has been completed in compliance with CEQA; and (3) the Initial Study/ Mitigated Negative Declaration represents the independent judgment and analysis of the City of Pleasanton as lead agency for the Project. SECTION 2. The City Council does find that based upon the entire record of proceedings before it and all information received that there is no substantial evidence that the Project, as mitigated, will have a significant effect on the environment and does hereby approve and adopt the Mitigated Negative Declaration prepared for the Project (CIP No. 20771).
