Resolution No. 23-1358 <br /> Page 2 of 3 <br /> WHEREAS, in September and October 2022, HCD contacted the City with several <br /> questions and comments about the draft Housing Element; and <br /> WHEREAS, on November 14, 2022, the City received a letter from HCD providing its <br /> findings regarding the draft Housing Element; and <br /> WHEREAS, on January 4, 2023, the City published a revised draft Housing Element <br /> responding to HCD's findings and requested public comment on the draft; and <br /> WHEREAS, on January 11, 2023, the Planning Commission conducted a duly and <br /> properly noticed public hearing, reviewed the Housing Element and all pertinent maps, documents <br /> and exhibits, including HCD's findings, the City's response to HCD's findings, the staff report and <br /> all attachments, and oral and written public comments; determined the Housing Element to be <br /> consistent with State law and the General Plan of the City; and recommended the City Council <br /> adopt the Housing Element; and <br /> WHEREAS, on January 26, 2023, the City Council conducted a duly and properly noticed <br /> public hearing, reviewed the Housing Element and all pertinent maps, documents and exhibits, <br /> including HCD's findings, the City's response to HCD's findings, the staff report and all <br /> attachments, and oral and written public comments; and determined the Housing Element to be <br /> consistent with State law and the General Plan of the City. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. Finds that the foregoing recitals are true and correct and are incorporated <br /> by reference into this action. <br /> SECTION 2. The City Council finds that the Housing Element substantially complies with <br /> Housing Element Law, as provided in Government Code Sections 65580 et seq. and contains all <br /> provisions required by State Housing Element Law, as shown in Exhibit A2 to this resolution, <br /> incorporated herein by this reference. <br /> SECTION 3. The City Council finds that based on substantial evidence in the record <br /> including that non-vacant higher density RHNA sites are primarily underutilized as surface parking <br /> and/or surface parking with commercial buildings where the existing uses are of marginal <br /> economic viability, the structures are at or near the end of their useful life, and the City has <br /> received affirmative interest in developing housing, the existing uses on the non-vacant sites <br /> identified in the site inventory to accommodate the RHNA are likely to be discontinued during the <br /> planning period and therefore do not constitute an impediment to planned residential development <br /> on the sites during the planning period, as described more particularly in Exhibit A3 to this <br /> resolution, incorporated herein by this reference. <br /> SECTION 4. The City Council finds that the Housing Element incorporates the City's <br /> goals, quantifiable objectives, and policies to affirmatively further fair housing and the <br /> maintenance, preservation, improvement and development of housing per Government Code <br /> Section 65583(b). <br /> SECTIONS. The City Council adopts the 2023-2031 6 1 Cycle Housing Element in its <br /> entirety and adopts the 6th Cycle Housing Element (Exhibit B) that has been modified in response <br /> to the findings of the Department (Exhibit Al) as being in substantial compliance with the <br /> requirements of State Housing Element Law (Exhibit A2). <br />
