Resolution No. PC-2023-06 <br />Page Two <br /> <br /> <br />Section 1. Finds it has independently reviewed and analyzed the Addendum and other <br />information in the record, including the EIR as supplemented by the SEIR, and has considered <br />the information contained therein, prior to recommending approval of the Project; the Addendum <br />has been completed in compliance with CEQA; and the Addendum represents the independent <br />judgment and analysis of the City of Pleasanton as lead agency for the Project. <br /> <br />Section 2. The Planning Commission recommends the City Council make the following <br />findings for adoption of the Addendum based upon the entire record of proceedings before it and <br />all information received that: <br /> <br />1. The conditions described in CEQA Guidelines Section 15183 and 15162 have not <br />occurred and the Commission finds that the previously prepared EIR and SEIR, including the <br />adopted CEQA Findings and Statement of Overriding Considerations and are adequate to serve <br />as the environmental documentation for the Project and satisfy all the requirements of CEQA; and <br /> <br />2. The Addendum concluded the implementation of the Project would not result in any new <br />or more significant impacts to the environment, or result in any unstudied significant impacts that <br />are peculiar to the parcel; and <br /> <br />3. There is no substantial evidence the Project will have a new or more severe significant <br />effect on the environment, or result in any unstudied significant impacts that are peculiar to the <br />parcel and recommends the City Council adopt the Addendum and incorporate its conclusions <br />and reasoning by reference. The Addendum is: (1) on file in the Planning Division located at 200 <br />Old Bernal Avenue, Pleasanton, California 94566; and (2) available for inspection by any <br />interested person/party. <br /> <br />Section 3. Recommends the following findings for approval of Case No. PUD-136: <br /> <br />With respect to the Case No. PUD-136, the Planning Commission recommends the City Council <br />make the following findings and determinations with respect to each of the considerations for a <br />PUD Development Plan as required by Section 18.68.110 of the PMC: <br /> <br />1. Whether the plan is in the best interests of the public health, safety, and general welfare: <br />The Project, as conditioned, meets all applicable City standards concerning public health, <br />safety, and welfare. The Project would include the installation of all required on-site utilities <br />with connections to municipal systems to serve the new development. With the recommended <br />traffic mitigations, the Project will not generate volumes of traffic that cannot be accommodated <br />by existing City streets and intersections in the area. The structures would be designed to <br />meet the requirements of the Uniform Building Code, Fire Code, and other applicable City <br />codes. Adequate access would be provided to the structures for police, fire, and other <br />emergency response vehicles. Stormwater run-off from the site will be treated before leaving <br />the site. Construction hour limits and dust suppression requirements w ould minimize <br />construction impacts on the surrounding residents and tenants. The Project is compatible with <br />the adjacent uses and would be consistent with the existing scale and character of the area . <br />Therefore, it is recommended the proposed PUD development plan is in the best interests of <br />the public health, safety, and general welfare, and this finding can be made.
