Resolution No. PC-2023-06
Page Two

Section 1. Finds it has independently reviewed and analyzed the Addendum and other
information in the record, including the EIR as supplemented by the SEIR, and has considered
the information contained therein, prior to recommending approval of the Project; the Addendum
has been completed in compliance with CEQA; and the Addendum represents the independent
judgment and analysis of the City of Pleasanton as lead agency for the Project.

Section 2. The Planning Commission recommends the City Council make the following
findings for adoption of the Addendum based upon the entire record of proceedings before it and
all information received that:

1. The conditions described in CEQA Guidelines Section 15183 and 15162 have not
occurred and the Commission finds that the previously prepared EIR and SEIR, including the
adopted CEQA Findings and Statement of Overriding Considerations and are adequate to serve
as the environmental documentation for the Project and satisfy all the requirements of CEQA; and

2. The Addendum concluded the implementation of the Project would not result in any new
or more significant impacts to the environment, or result in any unstudied significant impacts that
are peculiar to the parcel; and

3. There is no substantial evidence the Project will have a new or more severe significant
effect on the environment, or result in any unstudied significant impacts that are peculiar to the
parcel and recommends the City Council adopt the Addendum and incorporate its conclusions
and reasoning by reference. The Addendum is: (1) on file in the Planning Division located at 200
Old Bernal Avenue, Pleasanton, California 94566; and (2) available for inspection by any
interested person/party.

Section 3. Recommends the following findings for approval of Case No. PUD-136:

With respect to the Case No. PUD-136, the Planning Commission recommends the City Council
make the following findings and determinations with respect to each of the considerations for a
PUD Development Plan as required by Section 18.68.110 of the PMC:

1. Whether the plan is in the best interests of the public health, safety, and general welfare:
The Project, as conditioned, meets all applicable City standards concerning public health,
safety, and welfare. The Project would include the installation of all required on-site utilities
with connections to municipal systems to serve the new development. With the recommended
traffic mitigations, the Project will not generate volumes of traffic that cannot be accommodated
by existing City streets and intersections in the area. The structures would be designed to
meet the requirements of the Uniform Building Code, Fire Code, and other applicable City
codes. Adequate access would be provided to the structures for police, fire, and other
emergency response vehicles. Stormwater run-off from the site will be treated before leaving
the site. Construction hour limits and dust suppression requirements w ould minimize
construction impacts on the surrounding residents and tenants. The Project is compatible with
the adjacent uses and would be consistent with the existing scale and character of the area .
Therefore, it is recommended the proposed PUD development plan is in the best interests of
the public health, safety, and general welfare, and this finding can be made.
