ATTACHMENT 1 <br /> DRAFT RESOLUTION NO. 23- <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br /> APPROVING THE ALTAMONT LANDFILL AND RESOURCE RECOVERY FACILITY <br /> OPEN SPACE ADVISORY COMMITTEE, LISTS OF GENERAL PRIORITY AREAS <br /> WHEREAS, as part of the Altamont Landfill Settlement Agreement among the County of <br /> Alameda, the Cities of Livermore and Pleasanton, the Sierra Club, the Northern California <br /> Recycling Association (NCRA), and Altamont Landowners Against Rural Mismanagement and <br /> Waste Management of Alameda County. Inc. (dated November 30. 1999), hereafter referred <br /> to as, "Settlement Agreement", provides for collection of a per ton fee from the Altamont Landfill <br /> and Resource Recovery Facility for impacts on the communities due to expansion of the landfill, <br /> and <br /> WHEREAS, pursuant to the Settlement Agreement. the County convened the Altamont <br /> Landfill Open Space Advisory Committee consisting of one member appointed by the Board of <br /> Supervisors, one member appointed by the Livermore City Council, one member appointed by <br /> the Pleasanton City Council, and one member appointed by the Sierra Club; and <br /> WHEREAS, the funds allocated to the Open Space Fund are dedicated to the acquisition <br /> in fee or permanent easement of properties with significant value for preservation of native <br /> biological diversity and/or wildlife, and properties having significant value for visual character <br /> and/or non-motorized recreation, and <br /> WHEREAS, the Settlement Agreement requires that the Committee prepare two priority lists <br /> of properties for acquisition in fee or permanent easement, one for each of the geographic areas <br /> of concern as defined in Subsection 7.3.1 and <br /> WHEREAS, the Settlement Agreement states that by approval of a majority of the members <br /> of the Advisory Committee and concurrence by the County and Cities up to five percent of the <br /> funds received in any given year may be expended for the services of independent consultants <br /> to aid the Open Space Advisory Committee in carrying out its duties to identify open space areas <br /> in need of protection and to make plans for their acquisition; and <br /> WHEREAS, on September 16, 2022, the Open Space Advisory Committee did vote to refer <br /> the lists of general priority areas (attached to this resolution as Exhibit A) to the County of <br /> Alameda Board of Supervisors and the City Councils of Livermore and Pleasanton for <br /> concurrence. <br /> NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL OF THE CITY OF <br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. The Pleasanton City Council does accept the lists of general priority areas <br /> (attached to this resolution as Exhibit A) adopted by the Committee. pursuant to Subsection <br /> 7.4 2 of the Settlement Agreement. <br /> SECTION 2. City Clerk shall certify to the passage of this resolution and enter it into the <br /> book of original resolutions. <br />
