Approve Modification of the License Agreement between Alameda County and the East Bay <br /> Regional Park District(EBRPD) for the use of the Alameda County Transportation Corridor <br /> in Dublin and Pleasanton to extend the license an additional 10 years and to amend the <br /> revocation provisions of the original agreement. <br /> 2.) Authorize the President of your Board to execute the Modification of License Agreement on <br /> behalf of Alameda County, <br /> SUAIN ARY/DISCUSSION: <br /> The Alameda County Board of Supervisors authorized the County to enter into a License <br /> Agreement with the EBPRD by Resolution No. R-99-80 to use portions of the County's <br /> Transportation Corridor through Dublin and Pleasanton to develop, operate and maintain certain <br /> trail facilities to form part of the EBPRD Iron Horse Trail from Concord in Contra Costa County <br /> to Pleasanton. The original License Agreement was for a period of 25 years with additional ten <br /> year extensions upon mutual agreement by both parties. EBRPD has secured Federal funding to <br /> facilitate additional improvements to the Iron Horse Trail but this funding is contingent on <br /> EBRPD having continued use of the property for 20 years. The proposed modification to the <br /> original License Agreement will extend the term an additional 10 years (from 25 to 35 years), <br /> which will provide EBRPD the time period necessary to fulfill the Federal funding requirements <br /> for the Federally funded trail improvements. The modification will also amend the provision <br /> relating to when and how the License Agreement may be terminated in order for the County or <br /> "To Serve and Preserve Our Corrununity" <br />
