City of Pleasanton 2023-2031 (6th Cycle) Housing Element Update <br />CEQA Findings of Fact and Statement of Overriding Considerations <br /> <br /> <br />112 FirstCarbon Solutions <br />Https://adecinnovations.sharepoint.com/sites/PublicationsSite/Shared Documents/Publications/Client (PN-JN)/2148/21480022/FOF/21480022 Pleasanton Housing Element FOF.docx <br />Program 1.6 of the Noise Element, implementation of MM NOI-2 would require preparation of a <br />Construction Vibration Reduction Plan. <br />Operational Vibration Impacts: Development consistent with the Housing Element Update would <br />involve residential and commercial land use development. This type of land use development is not <br />anticipated to not include any permanent sources of vibration that would expose persons in the <br />project vicinity to excessive groundborne vibration levels (Draft Program EIR, Page 3.11-25–27). <br />The City finds that MM NOI-2 is feasible, is adopted, and will further reduce impacts associated with <br />noise and vibration. Accordingly, the City finds that, pursuant to Public Resources Code Section <br />21081(a)(1) and State CEQA Guidelines Section 15091(a)(1), changes or alterations have been <br />required in, or incorporated into, the Housing Element Update that mitigate or avoid the potentially <br />significant impacts as identified in the Program EIR. Therefore, impacts associated with noise and <br />groundborne vibration would be less than significant with mitigation incorporated. <br />1.7 - Impacts Identified in the Program EIR as Being Significant and <br />Unavoidable Even After the Incorporation of All Feasible Mitigation <br />Measures <br />The lead agency hereby finds that, despite the incorporation of mitigation measures outlined in the <br />Program EIR and the attached MMRP, the following impacts from the Housing Element Update and <br />related approvals cannot be fully mitigated to a less than significant level and a Statement of <br />Overriding Considerations is therefore included herein. <br />1.7.1 - Transportation <br />Impact TRANS-2: Development consistent with the Housing Element Update, rezonings, and General <br />and Specific Plan Amendments would conflict or be inconsistent with CEQA Guidelines Section <br />15064.3, subdivision (b) (Draft Program EIR, Page 3.14-23). <br />Findings: Changes or alterations have been required in, or incorporated into, the Housing <br />Element Update which avoid or substantially lessen the significant environmental <br />effects as identified in the Program EIR. (State CEQA Guidelines, § 15091(a)(1)). <br />However, impacts would still remain significant and unavoidable even with <br />mitigation incorporated. Specific economic, legal, social, technological, or other <br />considerations, including provision of employment opportunities for highly trained <br />workers, make infeasible the mitigation measure or project alternatives identified in <br />the Program EIR. (State CEQA Guidelines, § 15091(a)(3)) <br />Mitigation Measures <br />MM TRANS-2 Implement Vehicle Miles Traveled Reduction Measures. <br />Prior to the issuance of certificate of occupancy, a project applicant for an individual <br />housing project development proposal that does not screen out from Vehicle Miles <br />Traveled (VMT) impact analysis, as determined by a qualified consultant using the <br />methods applied in this Draft Program EIR, with modifications as deemed
