City of Pleasanton 2023-2031 (6th Cycle) Housing Element Update <br />CEQA Findings of Fact and Statement of Overriding Considerations <br /> <br /> <br />110 FirstCarbon Solutions <br />Https://adecinnovations.sharepoint.com/sites/PublicationsSite/Shared Documents/Publications/Client (PN-JN)/2148/21480022/FOF/21480022 Pleasanton Housing Element FOF.docx <br />Mechanical Equipment Operations: Noise levels from typical residential mechanical ventilation <br />equipment are anticipated to range up to approximately 60 dBA Leq at a distance of 25 feet. Program <br />4.6 of the Noise Element requires developers of new projects that would significantly increase noise <br />in nearby homes to mitigate noise impacts with walls, berms, or other measures and/or to provide <br />noise-attenuating measures in the homes. Program 5.2 of the Noise Element requires developers of <br />new projects to locate new noise sources away from noise-sensitive land uses unless development <br />plans include appropriate mitigation measures. To ensure compliance with these programs and the <br />City’s noise performance standards, MM NOI-1 shall be implemented, which requires preparation of <br />a noise analysis for any development that would locate noise producing mechanical systems within <br />25 feet of a project property line. If potential noise impacts are identified, then mitigation must also <br />be identified (Draft Program EIR, Page 3.11-19–25). <br />The City finds that MM NOI-1 is feasible, is adopted, and will further reduce impacts associated with <br />noise. Accordingly, the City finds that, pursuant to Public Resources Code Section 21081(a)(1) and <br />State CEQA Guidelines Section 15091(a)(1), changes or alterations have been required in, or <br />incorporated into, the Housing Element Update that mitigate or avoid the potentially significant <br />impacts as identified in the Program EIR. Therefore, impacts associated with noise would be less <br />than significant with mitigation incorporated. <br />Potential Effect <br />Impact NOI-2: Development consistent with the Housing Element Update, rezonings, and General <br />and Specific Plan Amendments could result in generation of excessive groundborne vibration or <br />groundborne noise levels (Draft Program EIR, Page 3.11-25). <br />Findings: Less than significant impact with mitigation incorporated (Draft Program EIR, Page <br />3.11-27). Changes or alterations have been required in, or incorporated into, the <br />Housing Element Update which avoid or substantially lessen the significant <br />environmental effects as identified in the Program EIR. (State CEQA Guidelines, § <br />15091(a)(1)) <br />Mitigation Measures <br />MM NOI-2 Construction Vibration Reduction Plan <br />For any future development projects that would use pile-driving within 200 feet of <br />an off-site structure, prior to the issuance of grading permits for a project, the <br />project sponsor shall retain a Noise Specialist to prepare a Construction Vibration <br />Reduction Plan for submittal to the City’s Planning Director for review and approval <br />that identifies specific techniques, such as the depth and location of temporary <br />trenching, that would reduce potential vibration impacts to less than significant for <br />any impacted structures. Upon approval by the City, the construction vibration <br />reduction measures shall be incorporated into the construction documents. A note <br />shall be provided on grading and building plans indicating that, during grading and <br />construction, the property owner/developer shall be responsible for requiring <br />contractors, to be monitored via on-site inspection by the Community Development
