City of Pleasanton 2023-2031 (6th Cycle) Housing Element Update <br />CEQA Findings of Fact and Statement of Overriding Considerations <br /> <br /> <br />32 FirstCarbon Solutions <br />Https://adecinnovations.sharepoint.com/sites/PublicationsSite/Shared Documents/Publications/Client (PN-JN)/2148/21480022/FOF/21480022 Pleasanton Housing Element FOF.docx <br />These policies and programs include, but are not limited to, Goal 2, Policy 5, Programs 5.1, 5.2, 5.3, <br />5.4, 5.5, Policy 6, Programs 6.1, 6.2, 6.3, 6.4, 6.5, and 6.6, and Policy 7, which would implement <br />standards to assist City decision-makers in the evaluation of development proposals and <br />management of geologic hazard areas. Development consistent with the Housing Element Update <br />would be required to comply with Chapter 20.08 of the Municipal Code, which implements the CBC. <br />The CBC includes requirements to address soil-related hazards, such as expansive soils. Under <br />Section 17.12.100 (Additional Regulations) of the Municipal Code, the HCD, with the consent of the <br />City Council, may adopt such standards or regulations as are necessary to protect the public from <br />geologic hazards. Future proposed projects located within areas susceptible to expansive soils would <br />be required to conduct an environmental analysis at the time a specific project is defined, including <br />preparation of site-specific soils and geologic reports for review and approval by the City Engineer, <br />and incorporation of the recommended programs during construction. (Draft Program EIR, Page 3.6- <br />31–32). <br />Potential Effect <br />Impact GEO-5: Development consistent with the Housing Element Update, rezonings, and General <br />Plan and Specific Plan Amendments would not have soils incapable of adequately supporting the use <br />of septic tanks or alternative wastewater disposal systems where sewers are not available for the <br />disposal of wastewater. (Draft Program EIR, Page 3.6-32). <br />Findings: Less than significant impact. <br />Facts in Support of Findings: Most of the potential sites for rezoning are infill sites; thus, new <br />development consistent with the Housing Element Update would primarily occur on parcels that <br />already contain existing homes or businesses. As such, development consistent with the Housing <br />Element Update would be served by the existing sewer system, and most new development would <br />connect to existing sewer lines. Should any new development require the installation of septic tanks <br />or alternative wastewater disposal systems, the General Plan includes policies and programs to <br />ensure that new development can be feasibly constructed according to soil conditions. Program 5.2 <br />requires a site-specific geologic and/or geotechnical engineering study prior to development for <br />areas with slopes equal to or greater than 20 percent. Program 5.2 requires the mitigation of <br />potential geologic safety hazards during the installation of infrastructure to be incorporated into <br />project design, which would also ensure that the development of septic tanks or alternative <br />wastewater disposal systems can be constructed according to soil conditions. Program 5.5 <br />discourages development, including the development of septic tanks, in areas with high risk of <br />geologic hazards. Chapter 15 (Sewerage) of the Municipal Code includes provisions to protect the <br />public health and safety by establishing and providing a mechanism for enforcing performance <br />standards for private sewer laterals that connect or are connected to a public sewer main, and to <br />maintain all parts of the sewer system and reduce and prevent sanitary sewer overflows. Section <br />15.16.020 (Private Disposal of Sewage) requires that a permit be obtained for the installation of <br />individual waste disposal systems, including septic systems, and that all work comply with the <br />provisions of Chapter 15.16.020, including meeting the minimum requirements of the County health <br />department and any applicable provisions of City Council policies. (Draft Program EIR, Page 3.6-32– <br />33).
