RESOLUTION NO. 23-1352 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br /> DELEGATING AUTHORITY TO THE CITY MANAGER OR THEIR DESIGNEE TO <br /> AWARD CONTRACTS AND EXECUTE AGREEMENTS ON BEHALF OF THE CITY <br /> FOR STORM-RELATED PURCHASES DURING THE EXISTENCE OF THE LOCAL <br /> EMERGENCY <br /> WHEREAS, on January 9, 2023, the City Manager, acting as the Director of Emergency <br /> Services, did proclaim the existence of a local emergency within the city due to severe storms per <br /> Municipal Code section 2.44.060.A.1.; and <br /> WHEREAS, when such a local emergency is in effect, the Director of Emergency Services <br /> is authorized to obtain vital supplies and equipment if required immediately per Municipal Code <br /> section 2.44.060.A.6.b.; and <br /> WHEREAS, due to the dynamic nature of the severe storms which have given rise to the <br /> local emergency, the City Council recognizes that the need for the City to obtain vital supplies <br /> and equipment, and contract for emergency services, may be time-sensitive and sudden, and <br /> delegating authority to the City Manager or their designee will allow for timely purchasing for the <br /> benefit of the public health, safety and welfare. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. That for the duration of the local emergency due to severe storms, that the <br /> City Council delegates authority to the City Manager, or their designee, to award contracts or <br /> enter into agreements on behalf of the City to purchase supplies, or entry into contracts for <br /> services (collectively the "purchases") needed to respond to the effects of the severe storm. Such <br /> time sensitive purchases shall not be subject to formal bidding procedures or the requirement that <br /> the City Council approve such purchases in advance (which would otherwise be required by <br /> Municipal Code Chapter 3.32, and Sections 2.08.160 and 3.28.010; or the Purchasing Procedures <br /> and Manual; or state law). <br /> SECTION 2. The City Council requires that the City Manager report to the City Council <br /> all actions taken pursuant to this Resolution at the next meeting of the City Council until the local <br /> emergency due to severe storms is terminated by the City Council. <br /> SECTION 3. Finds that California Public Resources Code §21080(b)(2) to (4) exempts <br /> from the California Environmental Quality Act actions and projects undertaken in response to an <br /> emergency. <br /> SECTION 4. This resolution shall become effective immediately upon its passage and <br /> adoption. <br /> SECTION 5. City Clerk shall certify to the passage of this resolution and enter it into the <br /> book of original resolutions. <br />
