ATTACHMENT 1 <br /> RESOLUTION NO. <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON RATIFYING <br /> THE CITY MANAGER / DIRECTOR OF EMERGENCY SERVICES' PROCLAMATION <br /> OF THE EXISTENCE OF A LOCAL EMERGENCY DUE TO SEVERE STORMS <br /> WHEREAS, Section 2.44.060 of the Pleasanton Municipal Code empowers the Director <br /> of Emergency Services / City Manager to proclaim a local emergency if the City Council is not in <br /> session, and requires that the City Council ratify the proclamation within seven (7) days thereafter,- <br /> and <br /> hereafter;and <br /> WHEREAS, on January 9, 2023, the City Manager, acting as the Director of Emergency <br /> Services, did proclaim the existence of a local emergency within the city due to severe storms; <br /> and <br /> WHEREAS, beginning late in December 2022 through early 2023, and predicted to <br /> continue into January 2023, the City of Pleasanton has experienced, and will continue to be <br /> subject to, severe rainstorms and atmospheric river systems resulting in risks to the health, safety, <br /> and welfare of persons and property due to flooding, downed trees, loss of power and property <br /> damage. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: <br /> SECTION 1. That the "Proclamation of the Existence of a Local Emergency", as issued <br /> by the Director of Emergency Services / City Manager, on January 9, 2023, attached hereto, is <br /> hereby confirmed. <br /> SECTION 2. Finds that California Public Resources Code §21080(b)(2) to (4) exempts <br /> from the California Environmental Quality Act actions and projects undertaken in response to an <br /> emergency. <br /> SECTION 3. That the local emergency shall be deemed to continue to exist until its <br /> termination is proclaimed by the City Council of the City of Pleasanton. <br /> SECTION 4. This resolution shall become effective immediately upon its passage and <br /> adoption. <br /> SECTION 5. City Clerk shall certify to the passage of this resolution and enter it into the <br /> book of original resolutions. <br /> PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at <br /> a special meeting held on January 11, 2023. <br />
