ATTACHMENT 1 RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON RATIFYING THE CITY MANAGER / DIRECTOR OF EMERGENCY SERVICES' PROCLAMATION OF THE EXISTENCE OF A LOCAL EMERGENCY DUE TO SEVERE STORMS WHEREAS, Section 2.44.060 of the Pleasanton Municipal Code empowers the Director of Emergency Services / City Manager to proclaim a local emergency if the City Council is not in session, and requires that the City Council ratify the proclamation within seven (7) days thereafter,- and hereafter;and WHEREAS, on January 9, 2023, the City Manager, acting as the Director of Emergency Services, did proclaim the existence of a local emergency within the city due to severe storms; and WHEREAS, beginning late in December 2022 through early 2023, and predicted to continue into January 2023, the City of Pleasanton has experienced, and will continue to be subject to, severe rainstorms and atmospheric river systems resulting in risks to the health, safety, and welfare of persons and property due to flooding, downed trees, loss of power and property damage. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1. That the "Proclamation of the Existence of a Local Emergency", as issued by the Director of Emergency Services / City Manager, on January 9, 2023, attached hereto, is hereby confirmed. SECTION 2. Finds that California Public Resources Code §21080(b)(2) to (4) exempts from the California Environmental Quality Act actions and projects undertaken in response to an emergency. SECTION 3. That the local emergency shall be deemed to continue to exist until its termination is proclaimed by the City Council of the City of Pleasanton. SECTION 4. This resolution shall become effective immediately upon its passage and adoption. SECTION 5. City Clerk shall certify to the passage of this resolution and enter it into the book of original resolutions. PASSED, APPROVED AND ADOPTED by the City Council of the City of Pleasanton at a special meeting held on January 11, 2023.
