<br />C-16 | City of Pleasanton Housing Constraints <br />monitoring program to determine rent price levels of ADUs being rented. However, the City has <br />not held up building permit issuance for execution of the restrictive covenant. <br />Emergency Shelters/Low Barrier Navigation Centers <br />The City’s Zoning Ordinance defines “homeless shelter” as housing with minimal supportive <br />services for homeless persons that is limited to occupancy of six months or less (see California <br />Health and Safety Code §50801(e)). Homeless or emergency shelters are allowed in the C-S <br />Zoning District with a conditional use permit and in the Service Facilities (SF) Overlay District as <br />a permitted use (approved ministerially with a zoning certificate, i.e., no discretionary action or <br />exception required) provided that all the requirements in Zoning Ordinance Chapter 18.82 are <br />met (see Table C-6). The requirements in Chapter 18.82 include the following: <br />• The number of beds shall not exceed 50. <br />• The number of beds shall not exceed one bed for each 400 square feet of lot area. <br />• One parking space for every four beds, plus one parking space for each employee on <br />the largest shift, plus one space for each company vehicle. <br />• No individual or family shall reside in a homeless shelter for more than 90 consecutive <br />days. Extensions up to a total stay of 180 days may be provided if no alternative <br />housing is available. <br />• Homeless shelters must be more than 300 feet apart. <br />Although, the number of required parking spaces is lower compared to that required for hotels <br />(i.e., one space per two beds) and for multi-family (see Tables C-4 and C-5), it does not reflect <br />the parking necessary to only accommodate shelter staff. Therefore, these requirements will be <br />amended to be consistent with state law, which requires sufficient parking for emergency shelter <br />staff, provided that it is not more parking than is required for other residential or commercial uses <br />within the same zone (Government Code §65583(a)(4)(A)). Furthermore, state law only allows a <br />separation requirement of up to 300 feet between emergency shelters. A program has been <br />included to amend the number of parking spaces require and separation requirement to be <br />consistent with the state law (e.g., limitation of a maximum separation requirement of 300 feet) <br />(Program 5.6). <br />The SF Overlay District applies to six parcels in Pleasanton that are within the C-S Zoning District <br />(see Table C-7), however three of the six sites have recently been developed. Three remaining <br />parcels are vacant or are currently developed with structures that could reasonably be converted <br />into a shelter facility. Each of the parcels is within one half mile of retail services or other <br />supporting services that occupants of the shelter could utilize or may have a need for, such as <br />grocery stores, clinics/hospitals, churches, schools, public transportation, etc. The surrounding <br />uses are retail and auto service orientated businesses, and not heavy industrial operations. <br />Additionally, the surrounding uses may offer potential of employment opportunities for those <br />shelter occupants pursuing employment.
