acceptance of completed water main construction. Said <br /> advance-in-aid may be ~or all or any part of cost of <br /> said water main extension. <br /> <br /> b) Source of monies for such advance-in-aid shall be the <br /> Water System Improvement Fund of the City. <br /> <br /> c) Each application for advance-in-aid under this Section <br /> shall include the following items which shall be <br /> evaluated by the City Council prior to allocation of <br /> funds: <br /> <br /> 1) Requested amount of advance. <br /> 2) Any public purpose which may be served. <br /> 3) Number of acres served in the development. <br /> 4) Potential fees from the development. <br /> 5) Any direct benefit to the Water System. <br /> <br /> d) The City Council may approve or reject any or all parts <br /> of any application made for advance-in-aid under this <br /> Section. Nothing contained in this Section shall be <br /> construed as requiring the City to spend all or any part <br /> of monies in the Water System Improvement Fund. <br /> <br /> SECTION 9: PAYMENT OF FEES. <br /> <br /> a) Connection charges shall be paid at the time of applica- <br /> tion for a building permit or installation of a water <br /> meter, whichever comes first. <br /> <br /> b) Front foot charges shall be paid for all of a property <br /> fronting an existing line for which reimbursement is <br /> due prior to the time that any part of that property <br /> is connected to the water system. This will normally <br /> be at the time of approval of a final map for new sub- <br /> divisions or at the time of application for a building <br /> permit or meter installation for other than subdivisions <br /> <br /> SECTION 10: CREDITS. A credit against connection charges <br /> shall be permitted for all lands subject to annexation agreements <br /> or subdivision agreements executed prior to the effective date of <br /> this Ordinance. This credit shall be calculated by the City <br /> Engineer, and shall be prorated where necessary. <br /> <br /> SECTION 11: If any section, subsection, sentence, clause or <br /> phrase of this Ordinance is for any reason held unconstitutional <br /> or in conflict with any statute or law of the United States of <br /> America, or the State of California, such decision shall not affec <br /> the validity of the remaining portions of the Ordinance. <br /> <br /> SECTION 12: All ordinances and parts of ordinances in <br /> conflict herewith are hereby repealed. <br /> <br /> SECTION 13: This Ordinance shall take effect and be in <br />force at the time provided by law, to-wit, thirty days after adop- <br />tion. <br /> <br /> SECTION 14: This Ordinance is hereby ordered to be printed <br />and published in "The Times", a newspaper of general circulation <br />published within the City. <br /> <br /> - 6 - <br /> <br /> <br />
