2 <br /> THE CITY Of <br /> ® ; CITY COUNCIL AGENDA REPORT <br /> PLEASANTON, <br /> December 20, 2022 <br /> City Attorney <br /> City Clerk <br /> City Manager <br /> TITLE: ADOPT FINDINGS REGARDING PUBLIC HEALTH RELATED TO THE <br /> COVID-19 PANDEMIC TO SUPPORT CONTINUED VIRTUAL PUBLIC CITY <br /> MEETINGS PER RESOLUTION NO. 21-1249 <br /> SUMMARY <br /> State law generally requires meetings of the City Council, commissions and committees <br /> to be held in person so that members of the public may watch and address decision- <br /> makers. These in-person open meeting requirements have been suspended due to the <br /> COVID-19 pandemic. The state currently allows local agencies to hold virtual public <br /> meetings. While the Council holds in-person meetings, some commissions, committees <br /> and subcommittees continue to meet virtually. State law (AB 361 of 2021) requires the <br /> City to make public health findings in order to carry on with virtual meetings. The <br /> Council adopted such public health findings on October 5, 2021 by Resolution No. 21- <br /> 1249, and confirmed the same on November 2 and December 7, 2021, and January 18, <br /> February 15, March 15, April 19, May 17, June 7, July 19, August 16, September 20, <br /> October 18, and November 15, 2022. <br /> RECOMMENDATION <br /> Adopt by minute order the following findings: <br /> 1. Confirmed COVID-19 case trends have been increasing since October 2022; and <br /> 2. The California Division of Occupational Safety and Health (a.k.a. Cal/OSHA) <br /> recommendations for building ventilation to reduce Covid spread include natural <br /> or mechanical ventilation, or both, to maximize the quantity of outdoor air <br /> provided. However, many commissions and committees meet in rooms where <br /> such ventilation is not possible. <br /> FINANCIAL STATEMENT <br /> No effect.
