ORDINANCE NO. 2241 <br /> AN ORDINANCE OF THE CITY OF PLEASANTON AMENDING TITLE 20 AND TITLE <br /> 18 OF THE PLEASANTON MUNICIPAL CODE TO ADOPT BY REFERENCE THE 2022 <br /> EDITION OF THE CALIFORNIA CODE OF REGULATIONS TITLE 24, INCLUDING THE <br /> 2021 INTERNATIONAL BUILDING, EXISTING BUILDING, RESIDENTIAL, FIRE, <br /> PROPERTY MAINTENANCE, AND SWIMMING POOL AND SPA CODES; THE 2021 <br /> UNIFORM PLUMBING AND MECHANICAL CODES; THE 2020 NATIONAL <br /> ELECTRICAL CODE AND THE 2022 CALIFORNIA GREEN BUILDING STANDARDS <br /> CODE <br /> WHEREAS, the State of California has revised and updated the California Building <br /> Standards Codes (Title 24 California Code of Regulations) related to buildings and construction <br /> to be effective State-wide on January 1, 2023; and <br /> WHEREAS, the City of Pleasanton traditionally adopts the California Building Standards <br /> Codes by reference so that the City has the most current standards available under State law, <br /> with some local amendments related to our local geological, topographical and climatic conditions,- <br /> and <br /> onditions;and <br /> WHEREAS, the City proposes, effective January 1, 2023, to repeal those previous <br /> California Building Standards Codes which will be superseded by the State's newest codes, and <br /> adopt the most current California Building Standards Codes, with local amendments supported <br /> by specific findings about Pleasanton's local geological, topographical, and climatic conditions; <br /> and <br /> WHEREAS, in 2022 the City adopted Climate Action Plan (CAP) 2.0 which includes <br /> Primary Action 1 to adopt an all-electric reach code for new construction that limits the <br /> development of new gas infrastructure (indicating that exemptions can be considered; and <br /> Primary Action 5, including multiple strategies towards a Zero Emission Vehicle Plan including <br /> that new construction be required to install Electric Vehicle (EV) charging capabilities; and <br /> WHEREAS, the California Health and Safety Code Sections 17958, 17958.5 and 17958.7 <br /> require the governing body of a city, before making any modifications or changes to the California <br /> Building Standards Code, to make an express finding that such modifications or changes are <br /> reasonably necessary because of local climatic, geological or topographical conditions; and <br /> WHEREAS, the City Council of the City of Pleasanton finds that a departure from the <br /> Building Standards Code is reasonable necessary due to the local climatic, geological or <br /> topographical conditions; and <br /> WHEREAS, the City Council of the City of Pleasanton finds that the amendments would <br /> be exempt from CEQA under Section 15061(b)(3), and would be consistent with the Initial <br /> Study/Negative Declaration for the CAP 2.0 which concluded that the CAP 2.0's actions would <br /> have a less that significant impact on the environment. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br /> HEREBY ORDAIN AS FOLLOWS: <br /> SECTION 1. The findings related to local climatic. geological. and topographical <br /> conditions as set forth in the attached Exhibit A are adopted. <br />
