IN THE NOT-TO-EXCEED AMOUNT OF $1,315,402 FOR <br /> ENVIRONMENTAL REGULATORY COMPLIANCE AND HABITAT <br /> MITIGATION SERVICES RELATED TO THE STREAM AND POND <br /> MAINTENANCE PROJECT THROUGH FISCAL YEAR 2029/30 <br /> SUMMARY <br /> The City seeks a contractor to provide assistance with environmental regulatory <br /> compliance and habitat mitigation services related to commencing maintenance work <br /> within stream segments and detention ponds for storm water conveyance, collectively <br /> referred to as the City's Stream and Pond Maintenance Project (SMP). Conducting such <br /> work requires permit approvals from state and federal regulatory authorities with <br /> jurisdictional authority over riparian areas. The permits have a five-year term for the <br /> maintenance activities associated with the SMP, with required annual monitoring for a <br /> minimum of six-years post-planting the mitigation area to determine establishment <br /> success. In addition to the permit conditions, similar specialized environmental <br /> assistance is needed to facilitate the City's Mitigation Monitoring and Reporting Program <br /> (MMRP) obligations from the California Environmental Quality Act (CEQA) <br /> environmental review for the SMP. <br /> Staff posted a formal Request for Proposals (RFP) for environmental regulatory <br /> compliance and habitat mitigation services for the SMP. Following proposal review, <br /> Sequoia Ecological Consulting, Inc., was selected based upon the established RFP <br /> evaluation criteria and follow up interviews and reference checks. Staff is proposing a <br /> seven and a half year agreement in the cumulative amount of $1,143,828 with a 15 <br /> percent contingency of $171,574 for a total not-to-exceed amount of $1,315,402. <br /> RECOMMENDATION <br /> Authorize the City Manager to enter into a seven and a half year Professional Services <br /> Agreement with Sequoia Ecological Consulting, Inc., with a not-to-exceed amount of <br /> $1,315,402, which includes a 15 percent contingency for environmental regulatory <br /> compliance and habitat mitigation services related to the City's SMP. <br /> FINANCIAL STATEMENT <br /> $310,000 is budgeted in the FY 2022/23 Operations Services Department budget within <br /> Storm Operations and Maintenance (44041601) to cover anticipated expenses for the <br /> current fiscal year. Appropriations anticipated in FY 2023/24 and FY 2024/25, will be <br /> requested in the upcoming two-year budget approval process. <br />
