BACKGROUND <br /> The City Council updated its City Council Meeting Rules of Procedure on July 19, 2022 <br /> (Resolution No. 22-1319). The prior 1995 City Council Rules and Operating Procedures <br /> referenced certain provisions that were not included in that action. These include: City <br /> Council eligibility for certain health and welfare benefits, and reimbursement policy and <br /> procedures for City Council. <br /> A. City Council Health and Welfare Benefits <br /> California law allows the City to provide the council with health and welfare benefits of <br /> the same type provided to staff.' In 1989, such council eligibility for health and welfare <br /> benefits was formalized by Resolution 89-493. In the 1995 Council Rules and Operating <br /> Procedures, that resolution was referenced in Section XI.E. Council and Mayor <br /> Compensation. That 1989 resolution is outdated and needs to be updated to reflect <br /> current health and welfare benefits provided to staff. <br /> B. Travel Reimbursement Policy for Elected and Appointed Officials <br /> California law provides that the council may be reimbursed for actual and necessary <br /> expenses incurred in the performance of their official duties.2 The 1995 Council Rules <br /> and Operating Procedures, set forth a policy in Section XI.F. (Reimbursement Policy <br /> and Procedures), and Appendix F. That 1995 policy is outdated and needs to be <br /> updated to reflect current practices and rates. <br /> DISCUSSION <br /> A. City Council Health and Welfare Benefits <br /> Attached for the City Council's consideration is a resolution reauthorizing City Council <br /> eligibility for certain health and welfare benefits. If adopted, members of the City Council <br /> could elect to receive the same health and welfare benefits as management and <br /> confidential employees (Attachment 1). <br /> B. Travel Reimbursement Policy for Elected and Appointed Officials <br /> Attached for the City Council's consideration is a resolution establishing a Travel and <br /> Reimbursement Policy for Elected and Appointed Officials (Attachment 2). If adopted, <br /> this policy would also apply to members of the City's Boards, Task Forces, <br /> Commissions, and Committees. This proposed policy establishes qualifying travel and <br /> other expenses, lodging cost limits and per diem meal rates, and reimbursement <br /> procedures. Such policy does provide for automatic administrative update of <br /> reimbursement rates based on the Internal Revenue Service (IRS) rates for <br /> reimbursement of travel, meals, lodging and other expenses as established by IRS <br /> Publication 463, or any successor publication, upon its effective date.3 <br /> ' See Cal.
